A new lawsuit filed against former Minneapolis police officer Derek Chauvin accuses him of using excessive force against a woman just months before the murder of George Floyd.
On Tuesday, Robins Kaplan LLP filed a lawsuit, seeking $9 million in damages, in federal court in Minnesota against Chauvin and his ex-partner, Ellen Jensen.
Costume alleged that in January 2020, about five months before George Floyd’s death, Chauvin and Jensen “violently pulled” a woman named Patty Day out of her car and threw her to the ground.
Chauvin then allegedly applied his knee to Day’s back as she lay handcuffed, the same posture he would infamously take for about nine minutes during his encounter with Floyd.
On Tuesday, Robins Kaplan LLP filed a lawsuit, seeking $9 million in damages, in federal court in Minnesota against Derek Chauvin and his ex-partner, Ellen Jensen.
Day says that due to the excessive force used against her, she suffered “significant” injuries to her arm and shoulder, as well as a broken tooth.
Meanwhile, Jensen did nothing to intervene, according to the lawsuit.
He goes on to argue that the city of Minneapolis was aware that officers in its police department had a history of “wanton use of excessive force.”
In the press release that accompanied the company’s filing of the complaint on Tuesday, Day said, “Unfortunately, my experience with Derek Chauvin is not unique.”
‘George Floyd died at the hands of this individual, and if the city had intervened in his behavior after my interaction, he might still be alive today… It was a traumatic part of my life that I hope no one else has to endure. .’
Day is seeking $9 million in compensatory damages, plus punitive damages in an amount to be determined by a jury.
Several years ago, former officer Chauvin was found guilty of second-degree murder in the killing of Floyd, an incident that launched the country into a summer of unrest and protests in the name of racial justice.
Chauvin is currently serving a 22-year sentence.

Last spring, the Minneapolis City Council agreed to settle two civil cases brought against Chauvin for nearly $9 million.
Both lawsuits alleged that the former law enforcement officer used excessive force several years before Floyd’s death, including one involving a 14-year-old boy.
The eight-figure settlement came two years after the city approved a historically large $27 million settlement with Floyd’s family.
Late last year, Chauvin was allegedly stabbed in prison.
