Woman sues JetBlue after suffering injury from ‘dangerously cold’ ice cream sandwich

A New Jersey woman is suing JetBlue for allegedly serving her a “solid frozen” ice cream sandwich that caused her to fracture one of her front teeth.

Kiara Quiñónez claimed that the flight crew gave her a Nightingale brand strawberry shortcake ice cream sandwich during an August 20 flight from JFK Airport in New York to Charles De Gaulle Airport in Paris, France.

The lawsuit argued that the candy was “at a temperature below what is reasonable or safe for consumption” and Quiñonez was not warned “about the dangerously cold temperature and solid state of the ice cream sandwich she was served.”

According to the lawsuit, Quiñónez suffered “serious and permanent bodily injuries” from biting into the ice cream sandwich, adding that he continues to incur expenses for ongoing treatment.

She is being represented by Christopher S. Fraser of the Dweck law firm, who demanded a jury trial to determine how much JetBlue should pay for the alleged damages.

Quiñonez allegedly suffered a root fracture to tooth number 10, also known as the upper left lateral incisor, which is right next to the left front tooth.

According to the lawsuit, he needed “immediate” medical treatment upon landing in Paris.

He stated that his injury required the tooth to be extracted, after which he received an implant and other additional treatments.

‘As a direct and proximate result of the acts of the defendant, his agents and/or servants as described above, the plaintiff suffered serious and permanent bodily injuries, suffered pain, suffering and mental anguish, and incurred expenses for medical care and treatment, all of which continue,” the lawsuit alleges.

The complaint was filed in the Eastern District Court of New York on October 22, months after the alleged incident occurred.

This comes months after another JetBlue passenger filed a lawsuit over severe burns she allegedly suffered from a spilled cup of hot tea.

Tahjana Lewis, a Connecticut woman, was traveling with her 5-year-old daughter on a flight from Orlando, Florida, to Hartford, Connecticut, in May, according to the June complaint.

Lewis claimed that when a flight attendant served the drink to a fellow traveler, the cup fell, causing the tea to spill on it.

According to the lawsuit, Lewis now has severe burns to his upper chest, legs, buttocks and right arm, some of which will be permanent.

The flight crew failed to “properly administer first aid” after the spill, according to the lawsuit.

Lewis sought compensation of more than $1.5 million, considering the severity of his injuries and the impact they have had on his ability to work at his job, according to the lawsuit.

A similar lawsuit was filed against JetBlue in 2017 by a 25-year-old woman who, like Lewis, claimed to have suffered severe second- and third-degree burns on her butt after allegedly being burned by unbearably hot tea during a flight.

Michelle Lavin claimed the incident occurred on Labor Day weekend in 2014, when she was flying to visit her older sister for a weekend getaway during a five-hour, 40-minute flight to Las Vegas from New York.
