Taylor Swift’s stalker will be committed to a mental health facility after a judge declared him unfit to stand trial.

Manhattan Criminal Court Judge Robert Rosenthal dismissed the criminal case against David Crowe, 33, in an adjourned hearing Friday.

‘David Crowe is not fit to stand trial. The criminal case has now been dismissed as a matter of law,” the Manhattan District Attorney’s Office told DailyMail.com.

“He will now be taken into the custody of the Office of Mental Health to receive the necessary treatment.”

This development comes just one day after a court-ordered psychiatric examination determined that Crowe “is unfit to proceed not only with the evaluation, but also with the review of his criminal record,” his attorney said at the time.

Last month, Crowe was arrested three times outside Taylor Swift's (pictured) home in Manhattan's Tribeca neighborhood, accused of stalking and harassing the star after being seen near her apartment 30 times since November.

Crowe will be transferred from his current incarceration at Rikers, where he was held on $100,000 bail during his trial, to the custody of the Office of Mental Health. TMZ He was the first to report.

The Seattle law student, who had previously violated a protective order ordering him to stay away from Swift and her home, has been seen outside his residence more than 30 times since November.

He was arrested a second time on Jan. 22 after police received reports that he was “acting erratically” outside Swift’s $20 million apartment on Franklin Street.

Later that week, on January 24, he was arraigned and the protective order was issued.

Crowe was charged with fourth-degree stalking and first- and second-degree harassment before being released under the supervision of a Manhattan judge.

But Crowe was seen diving into a large green trash bin outside the pop superstar’s home in Tribeca that same afternoon.

He looked inside from different angles and was seen by nearby neighbors who were concerned by his actions before the New York City Police Department arrested him.

An NYPD spokesperson said officers responded to a 911 call from a disruptive man on Franklin Street at 1:35 p.m.

Once the police arrived, he left the scene and entered the first police station where he was detained.

“I saw him digging in this dumpster, taking out some blankets and then he went and sat on the loading dock a few doors down (from Swift’s apartment),” one resident told the New York Post.

His sweatshirt included the quote from American author Ursula K Le Guin, which reads: ‘Love does not stay there, like a stone, but must be made, like bread; Remade all the time, made new.’

A neighbor told the New York Post that the man had been regularly seen outside the building since Christmas, sitting on the doorstep, chain-smoking and telling people he was there to see Swift. He even had flowers for her at one point.

An NYPD spokesperson said: “Multiple complainants approached officers and reported an emotionally disturbed man acting erratically at the location.”

“Once officers observed the man harassing several complainants, they took him into custody without further incident and no injuries were reported.”

Prosecutors said Crowe, of Seattle, has been seen at Swift’s Tribeca home up to 30 times since Nov. 25. He supposedly asked to speak to the singer several times.

According to prosecutors, Crowe was asked about 10 times not to approach the building or leave it.
