Justin Timberlake’s drunk driving drama in the Hamptons has taken a curious turn as his legal team has claimed that police allowed his friend, who had also been “clearly” drinking, to drive his car home after the arrest.
Timberlake, 43, was arrested on June 18 around 12:30 p.m. when a Sag Harbor Village Police Department officer pulled him over in the New York Hamptons village after he allegedly ran a stop sign and veered out of his lane while driving a 2025 BMW X7, according to a court document.
The star told the officer he had a martini and was following friends home; he was later charged with misdemeanor drunk driving.
Timberlake’s attorney, Edward Burke, Jr., who claimed the singer was not intoxicated during the arrest, will now reportedly argue that the arresting officers let a person who had “clearly” been drinking drive away while they arrested Timberlake.

A woman and her husband were in the car, and the woman asked one of the officers, “Are you going to arrest Justin Timberlake?”
He then allegedly offered to drive Timberlake to his house where he would spend the night, but Timberlake was arrested.
Sources added that the woman asked the police if she could take the singer’s rental car to his house, to which the police agreed and she then drove away with the car.
The unknown woman was said to have arrived at the American Hotel, where Timberlake had his famous martini, two hours before him and was drinking.

Burke Jr., who is seeking to have the case dismissed, will reportedly argue that police “erred” in their judgment and let a person who “clearly had been drinking drive away, right before his eyes.”
“If they couldn’t properly evaluate her, how could they properly evaluate him?”
Burke will reportedly make this argument to the judge as part of a motion to have the case dismissed. Timberlake is expected to appear virtually on Friday, August 2, for arraignment on a drunken driving charge.
Timberlake came under fire online after his lawyer claimed the star was “not drunk” the night of his drunk driving arrest at a court hearing on Friday.

Burke reportedly commented in court that prosecutors allegedly failed to “obtain a superior officer’s signature on the initial charging documents and therefore the case should be dismissed.”
He said: ‘The police made a number of very significant mistakes in this case.
‘Today in court, you heard the district attorney try to correct one of those mistakes. But that’s just one and there are many others. Sometimes police make mistakes and this is just one of those cases.’
Timberlake was not present in court on Friday nor did he appear virtually as he is on his Forget Tomorrow world tour in Poland.

Timberlake’s alleged intoxicated condition was detailed in court documents, which said: “His eyes were bloodshot and glassy, a strong odor of alcoholic beverage emanated from his breath, he was unable to divide his attention, had slowed speech, was unsteady on his feet, and performed poorly on all standardized field sobriety tests.
‘This is going to ruin the tour,’ the star is reported to have muttered.
The New York officer, who was too young to recognize Timberlake, asked, “What tour?” and was told, “The world tour.”
After being arrested and taken to a police station in nearby East Hampton, he refused to take a breathalyzer test, according to court documents, which listed his occupation as “professional” and said he was “self-employed.”
Timberlake came under fire online after his lawyer claimed the star was “not intoxicated” the night of his drunk driving arrest at a court hearing on Friday.
The memes came pouring in after Timberlake’s defense was revealed.
Justin and his wife Jessica Biel, pictured in May 2022, have been married since 2012.
The 10-time Grammy winner was released without bail later in the morning after being arraigned in Sag Harbor.
He rose to fame in the boy band juggernaut NSYNC, embarked on a solo recording career in 2002, and was one of the most influential figures in pop in the early 2000s.
Jessica Biel and Justin have been married since 2012 and have children together: Silas, nine, and Phineas, three.
Justin has continued his Forget Tomorrow world tour despite the arrest and Jessica has continued filming The Better Sister, which she also executive produces under her Iron Ocean Films banner.
Jessica also executive produced Hulu’s 2022 biographical crime drama series Candy, in which she played accused axe murderer Candy Montgomery and Justin had a recurring role on Candy as Deputy Steve Deffibaugh.
