The Supreme Court on Monday refused to suspend “scientific investigation” of the Bhojshala complex, a medieval structure that both Hindus and Muslims claim as theirs in Madhya Pradesh’s Dhar district, but said no action should be taken be undertaken without the permission of the Supreme Court. outcome of the ASI investigation.
Hindus consider Bhojshala, an Archaeological Survey of India (ASI) protected 11th century monument, as a temple dedicated to Vagdevi (goddess Saraswati), while the Muslim community calls it the Kamal Maula Mosque.
As per an arrangement made by the ASI on April 7, 2003, Hindus perform puja at the Bhojshala building on Tuesdays while Muslims offer namaz at the complex on Fridays.
A bench of Justices Hrishikesh Roy and PK Mishra issued notices to the Centre, Madhya Pradesh government, ASI and others on the plea filed by Maulana Kamaluddin Welfare Society against the March 11 order of the MP Supreme Court on scientific research.
“Notice of issuance may be returned within four weeks. In the meantime, no action shall be taken in respect of the outcome of the contested inquiry ordered without the consent of this court.
“It is made clear that no physical excavations shall be carried out which will alter the character of the property in question,” the bench said.
