A Delhi court on Wednesday prepared the hearing on former Deputy Chief Minister Manish Sisodia’s bail plea in CBI and ED cases related to the Delhi Excise Policy case.

The Special Judge, Kaveri Baweja of the Rouse Avenue Court, after going through the papers, decided to settle the matter before April 2, 2024. The bail hearing was previously scheduled for April 4.

The court has postponed the hearing of the bail application twice. Yesterday it was postponed until April 4.

Manish Sisodia has filed an application to postpone the date of his bail hearing. The application requested a hearing on April 1, 2024.

Earlier, Special Judge MK Nagpal heard the plea. However, he was transferred to Tis Hazari court on March 19. He had started hearing the plea after Manish Sisodia’s curative petition was dismissed by the Supreme Court.

On March 18, the CBI opposed the bail plea and said some high-profile people may be arrested. The investigation is ongoing and this suspect may hinder it.

Senior advocate Mohit Mathur started by stating that the Supreme Court (SC) has observed that 13 months have elapsed and granted bail to Benoy Babu.

The senior lawyer had also said, “I (Manish Sisodia) meet the three-fold test. He is not a flight risk. There is no chance of tampering with evidence. There is no evidence now. They have all become approvers.”

He further submitted that the fact is that there is no loss to the exchequer but gain to the exchequer. No loss for even an individual or a consumer. No money was paid by him and vice versa, Mathur said.

He also submitted that the main complaint and charge sheets have been filed. No development in terms of trial or snail’s pace. There are more than 400 witnesses and the trial has not yet started.

On the other hand, the bail plea was opposed by Assistant Public Prosecutor (APP) Pankaj Gupta. He argued that there was no delay on our part. The trial begins after the indictment. We’re trying to start with that. The suspects postpone the trial.

The CBI APP stated that some high-profile people may be arrested. The investigation is still ongoing and this suspect can influence the witnesses and hinder the investigation.

The application should be rejected, Pankaj Gupta said.
