A woman who was a teenager in an elite private school in Sydney when a teacher seduced her has looked at him in court.

The woman, who cannot be named for legal reasons, was a 17-year-old schoolgirl when Ben Fenner started sending her sexualized messages via WhatsApp.

“All messages here are encrypted … great for secrets,” he informed her, according to the agreed-upon facts.

Fenner has pleaded guilty to seven counts of sexual intercourse with a person under the age of 18 and in his care.

He asked Judge Robert Weber to consider another eight issues of sexual intercourse with his former student.

On Thursday, the woman read her victim impact statement in court and said it took a long time for her to realize she was being manipulated and cared for by her teacher.

“I thought this was normal … a normal relationship,” she said.

“He knew the rules and the code … he used me … I was a vulnerable 17-year-old, you were 33.”

At the time of the abuse, she was suffering from depression, anxiety and panic attacks after the loss of a family member.

“I feel like you took so much from me … my friends and high school experience,” she said.

“All messages here are encrypted … great for secrets,” Fenner told her, according to the agreed-upon facts

She said she was proud to report the “ perverse mess ” to the police so that Fenner could no longer use his position of power to abuse someone again.

After finishing her statement, she stared directly at Fenner, who had his head bowed.

Fenner provided evidence and apologized for causing her grief and pain, and ruining the time prior to her Higher School Certificate.

When asked if he knew what he was doing was wrong, a serious beach of trust and abuse of the teacher-student relationship, he consistently answered “yes.”

“You noticed there were some scars on her neck that you thought were hickeys … Then you asked what she liked sexually,” prosecutor Roger Kimbell said.

“That was totally inappropriate, wasn’t it?”

Fenner was born in England but moved to Sydney to start a new life after the breakup of his marriage in 2011.

He described philosophy at the eastern suburban school where he taught biology as significantly different from other schools where he had worked.

Teachers were encouraged to provide students with their personal telephone numbers and to be available for contact outside of regular school hours.

His text messages to his victim became sexual before he organized for three months to meet outside the school grounds.

In one case, she thought they were going to the beach for a school assignment, but he had sexual intercourse with her instead.

Attorney Phillip Gibson said Fenner felt unable to get out of the situation for fear of the depression and anxiety he experienced breaking up from previous relationships.

Although Fenner was not suffering from serious mental illness at the time, he had fallen back to an “emotional low” leading up to the insult.

The Crown said there is a gross power imbalance between a child and an adult.

“It’s not a case of a relationship between two consenting adults,” said Kimbell.

“He’s an intelligent professional man in his thirties, almost twice her age.”

Judge Weber will deliver his verdict on October 9.
