In a letter obtained by NBC Bay Area, the school administrators said that Persky had applied for his new position in the summer and had successfully met all of the district's recruitment conditions, including a fingerprint in the background.

& # 39; Persky is in his first year as an athletic coach in our district, & # 39; is stated in the letter. & # 39; He was a highly qualified applicant, has visited several tennis coaching clinics for young people, and has a high rating from the United States Tennis Association. & # 39;

Persky made headlines in 2016 when he gave Turner six months in prison after the then 20-year-old All-American swimmer was found guilty of sexually assaulting Chanel Miller behind a container outside a campus party that took place in January 2015.

In his ruling, the former judge said the facts that Turner was stunned when he committed the crime, that Turner had no prior criminal record, and that going to jail for the six years recommended by prosecutors would negatively impact Turner's long-term prospects – wrongly in Persky's opinion.

The former cold judge sentenced Turner to a maximum of 14 years in prison, but opted for leniency, noting that Turner's loved ones had submitted strong character witness letters and that he would have a crime on his criminal record for the rest of his life in addition to the register as sex offender.

"The media attention paid to the case has affected not only the victim in this case, but also Mr. Turner," said Persky, according to a hearing transcription obtained by the Guardian.

& # 39; You must take the entire photo in terms of what impact jail time has on the life of a specific individual. And the impact statements that are – or, really, letter letters submitted (on behalf of Turner) show a huge collateral effect for Mr. Turner based on the conviction. & # 39;
