Charles Basarab is said to have been left dead on Saturday night at 46-year-old Willie Hayes on train tracks in Pittsburgh.
Hayes says that witnesses bent over his alleged victim while lying unconscious on the rails and said, "I (exaggerated) told you that I would kill you."
His accusations include ethnic harassment, attempted manslaughter, and severe assault.
The alleged victim told investigators from his hospital bed that he remembered Hayes saying he was abusing him because he was white.
Police said the incident occurred at Wood Street station in downtown Pittsburgh on Saturday around 9:00 PM.
A & # 39; conscious but highly disoriented & # 39; Mr. Basarab was found there on the T-tracks by the police when they arrived.
Two witnesses told police that & # 39; Basarab was being attacked and then thrown onto the trolley by an unknown black man & # 39; who then fled the scene.

They said they were able to identify the suspect from surveillance images of a casino where he was before the alleged attack.
Basarab hit the right side of his head on the rails and was eliminated before being taken to the hospital to treat countless broken bones, bruises, cuts and facial injuries. He also had surgery for internal bleeding.
A SWAT team brought Hayes out of his house five miles north-east of downtown Pittsburgh on Thursday morning.
He was arrested and taken to jail and will appear in court in June after he was unable to pay bail.
