In April, Castillo sued the companies involved in the project for $50 million, alleging their negligence caused the accident and failed to protect the public.

He alleged that Kast “negligently and carelessly permitted an unsafe condition at his construction site and/or negligently and carelessly operated and/or constructed and/or installed and/or supervised the use of the crane such that it crashed into traffic below.”

Castillo’s attorneys claimed the crane was not properly inspected, assembled or moved and that shortcuts were taken to finish the building “on an unreasonably accelerated schedule.”
