Teacher acquitted of sexual crimes in the UK is jailed in Spain for 11 years for a student affair
A British teacher who has been acquitted of sexual crimes in the UK has been jailed for eleven and a half years for an affair with a teenage student in his new job in southern Spain.
Carlo Troiano, 42, moved to Spain following his acquittal during a trial in 2010 for allegations of sexual activity with a 16-year-old student at a school in Cheshire.
This month, the father of two from Wirral was sentenced and sentenced to imprisonment for the & # 39; continued sexual abuse & # 39; from a 15 year old student at St George & # 39; s British School of Almeria – his new school in southern Spain.
During the two-day trial of Troiano, which began on October 1 at the provincial court in Almeria, his victim described how her former teacher had seduced her by favoring her in the classroom, liking her Instagram photo & # 39; s and to get a tattoo done.
The former British teacher who was acquitted of sexual crimes in the UK in 2010 has now been imprisoned for a sexual affair with one of his new students at a school in southern Spain
The teenager said she was in her school uniform when Troiano offered her alcohol before she kissed her for the first time in April 2016.
She also told the three judges that when she told the 42-year-old that he & # 39; wasted his time & # 39 ;, he had pressured her to keep seeing him by insisting that he stop his job and would leave her class without a teacher.
She described finding a video that Troiano had of the two who had sex taken without her permission on his email.
She also revealed that her former teacher never used a condom when they were having sex, but would give her a morning-after pill he'd bought from his local chemist.
In a 29-page ruling released today, after two weeks of deliberation, the three judges described her testimony as & # 39; credible & # 39 ;.
They said the Troiano court claimed that they had no sex until she was 16 & # 39; did not earn any credit & # 39 ;, and judged it & # 39; unlikely & # 39; was that they had a platonic relationship the way he insisted.
They said the text messages the couple exchanged showed that Troiano was acting with a & # 39; tempting goal & # 39 ;.
In one of the text messages in the document, the 42-year-old told the teenager: & You are like my own Barbie in real life, I would like to dress and undress you, you looked fantastic in that short pants today after school, you make me very hard. & # 39;
In a court document, texts showed the teenage girl how the teacher had tried to seduce his student
In the ruling, the judges said that in the 2015/2016 academic year, Troiano was led by a libidinous desire & # 39; took advantage of his position and a & # 39; supposedly friendly relationship & # 39; started with the teenage girl when she was only 14, which led to continuous sexual abuse.
The three judges ruled over a six-month period from May 2016 that the teacher abused his position to sexually abuse the schoolgirl.
& # 39; He gave her preferential treatment and gradually succeeded in establishing a more personal and intimate relationship with her & # 39 ;, the judges wrote in the court ruling.
& # 39; In April 2016, he received her in his house where he kissed her on the mouth after insisting and winning her initial resistance.
& # 39; The relationship became more intense from about May 2016 and the accused had sex with the minor several times at his home. & # 39;
The abuse ended when the girl's mother discovered what was happening and reported Troiano to the police, who was then released from his teaching position and arrested.
He was held in pre-trial detention for almost a year and was released briefly on bail in December 2017.
However, after he had traveled abroad in a failed attempt to indict his victim, he was extradited to Germany and put back in Spain until his trial this month.
The Spanish judges were also critical of the school in Spain because they no longer did to protect students after news about the former acquittal of Troiano was discovered
In the court document, the judges also closed the school in Spain, now simply called the British School of Almeria, in the holiday resort Roquetas de Mar.
It criticized chief teacher Neil Morris for not firing the 42-year-old, or imposing measures to minimize the risk to school students, after uncovering details of the previous Google case.
In January 2010, Troiano, who is now divorced, was not found guilty of three allegations of causing or seducing sexual activity with a 16-year-old student in his classroom at Bankfield High School.
A jury of seven women and five men judged that they did not believe the 17-year-old had told the truth and unanimously acquitted him of all charges after a four-day trial at the Warrington Crown Court.
Despite his acquittal, a subsequent internal investigation saw the school governors dismiss Troiano.
He then moved to Spain, where he found a new job at the prestigious private school in Almeria and continued to teach until his arrest in 2016.
Chief Judge Luis Miguel Columna said in a suspicious indictment of the new school of Troiano in the court's verdict: “The school leaders discovered months after they had assumed that he had been tried and acquitted in the UK for sexual abuse.
& # 39; It was also reported that two teachers had seen the accused and the minor together outside school, in a supermarket and on the beach.
& # 39; Despite that, it took no special measures until the child's mother reported him, which was the moment they fired him. & # 39;
In addition to being imprisoned for eleven and a half years, the disgraced former teacher was banned from the classroom for the same period and ordered his victim to pay £ 43,180.
British Education System SL, the Spanish company that runs the old school of Troiano, was ordered to pay the fine if it failed to do so.
