Spencer Pratt, 41, and Heidi Montag, 38, have filed a lawsuit against the city of Los Angeles and the Department of Water and Power

Spencer Pratt and his wife Heidi Montag have filed a lawsuit against the city of Los Angeles and the Department of Water and Power.

Pratt, 41, and Montag, 38, lost their $2.5 million Pacific Palisades home to the devastating Los Angeles fires on January 8.

The couple has now joined other homeowners in suing the city over the damage to their property, according to The Hollywood Reporter.

Their lawsuit, filed in California Supreme Court in Los Angeles County on Tuesday, accuses the Los Angeles Department of Water and the powerhouse of “failing to maintain an adequate water supply system to combat the blazes.”

It further states that the fire “was an inescapable and unavoidable consequence” because of how the city and LADWP allegedly managed the area’s water supply.

It points to “delays in repairs to the Santa Ynez Reservoir, leaving the massive water storage complex in the heart of the Palisades empty for nearly a year.”

20 Other property owners have also joined the lawsuit, including Pratt’s mother Janet Pratt. His sister, Stephanie Pratt, previously confirmed that their parents’ home was also destroyed in the Palisades Fire, just hours after Spencer and Heidi’s home.

“With the Santa Ynez Reservoir effectively out of commission, the hydrants at Pacific Palisades failed after three tanks each holding a million gallons of water dried up within a 12-hour period,” the lawsuit alleges.

The lawsuit blames the LA Department of Water and Power for emptying the reservoir before the fire, “allegedly to seek bids rather than use in-house personnel to fix it.”

“This stated public purpose was far outweighed by the substantial risk posed to Pacific Palisades by wildfires,” the lawsuit said.

“The level of damage resulting from the Palisades fire far outweighed any benefit that could have been realized by outsourcing and delaying repairs.”

The lawsuit also claims reverse condemnation, which allows property owners to seek compensation for damages caused by public use. It’s looking for unspecified damage. ‘

Their damages include the cost of real estate, loss of enjoyment of real estate and lost wages.

Earlier this month, Spencer revealed his plans to sue the state of California after his house tragically burned down.

The former reality star announced that he plans to file a lawsuit against California over their alleged negligence that resulted in the loss of his residency.

While speaking to blogger, Perez Hilton, the father of two recalled desperate to get help from the Los Angeles Fire Department as he watched his property go up in flames.

‘They never came. The gate was still locked,” he claimed. ‘They never came. I watched from my security cameras until our house burned down. There were no fire trucks. ‘

As his house burned, Pratt insisted he called 911 and informed them that if they sent “one fire truck” to his street, they could “stop (the fire from) getting off the whole freaking area.”

In response to his suggestion to bring in a truck, he said he was told the fire department didn’t “have the assets.”

The couple’s home was flattened to the ground after the raging fire took over the LA landscape, causing fiery damage, and photos obtained by DailyMail.com showed the severity of the destruction.

The only parts of the house still standing were the charred entry gate and the front portion of the house’s stucco perimeter wall. Large piles of debris were seen throughout the property, as well as burned foliage that once decorated the home’s front yard.

His decision to charge comes amid widespread backlash against Los Angeles Mayor Karen Bass’ lack of preparation and quick response to the wildfires.

Several wildfires have recently affected the Los Angeles area.

The Eaton Fire that burned 14,021 acres east of Los Angeles was 91 percent contained, while the larger Palisades Fire, which has consumed 23,448 acres on the west side of Los Angeles, was at 68 percent contained as of Wednesday.

Since the two fires broke out on Jan. 7, they have burned an area nearly the size of Washington, D.C., killed 28 people and damaged or destroyed nearly 16,000 structures, Cal Fire said.
