A new court document has revealed that Special Counsel Jack Smith gained access to Donald Trump’s Twitter account – including private messages and draft tweets – after obtaining a secret search warrant during his investigations into the former president.

Smith is investigating Trump for alleged crimes aimed at obstructing the results of the 2020 election and also for his mishandling of classified documents.

The new file reveals he was able to access Trump’s private direct messages, tweet drafts and other information related to his old account, ‘@RealDonaldTrump’ as Smith continues his investigation.

The special counsel had obtained a secret search warrant in January to scour Trump’s Twitter account for evidence of criminal offenses related to his alleged efforts to overturn the 2020 election.

A judge then fined Elon Musk’s social media giant $350,000 for initially refusing to comply, according to documents released last week. The company, now known as “X”, was also barred from speaking to Trump about the mandate.

An unsealed court filing released Tuesday evening revealed that Twitter had produced the requested recordings.

According to an attorney on Smith’s special counsel team, investigators feared that if Trump learned of the warrant, he might try to “undermine” their investigation.

“There are in fact concrete and conscious reasons to believe that if the former president were informed of these secret investigative measures, there would be real harm and concern for the investigation, for future witnesses.”

An unsealed court filing released Tuesday evening revealed that Twitter had produced the requested recordings.

The filing says Smith obtained a search warrant directing Twitter to produce “data and records” related to Trump’s Twitter account.

It was not immediately clear what was contained in the content of the posts or tweet drafts.

According to a transcript included in the filing, a Twitter attorney said he sent “all direct messages, DMs” to the special advocate team, including those in “draft” form.

Additionally, the special advocates team had access to Trump’s “deleted” and “undeleted” direct messages.

He also slammed Smith for “breaking into” his Twitter account in a post on Monday.

Trump received a permanent ban from Twitter in January 2021 after the Capitol Riot.

Musk has since reinstated his account, but he still hasn’t posted.

His last message from January 8, 2021 reads: “To all those who have asked, I will not be going to the Inauguration on January 20.

Smith indicted Trump on 37 counts in June, including obstruction of justice for his handling of classified documents, to which he pleaded not guilty.

Additionally, the special counsel won federal criminal charges against Trump for his attempts to cling to power after losing the 2020 election.

A grand jury indictment earlier this month accuses him of spreading “lies” and “fictitious” investigations while stirring up an “angry” crowd on January 6.

Smith said in a televised public statement following the release of the indictment that the attack on the Capitol was ‘fueled by lies’ by Trump ‘designed to obstruct the fundamental function of the United States government – the national process for collecting, counting and certifying the results of the presidential election.

He promised that his office would conduct a “speedy” trial.
