Gary Poltash, 64, from Florida, and mother-of-three Suzana Brito, 48, from Ontario, were killed on August 24 when the boat that crashed into Linda crashed into another ship on a nightly outing on Lake Joseph.

In September, Ontario provincial police accused Linda of & # 39; carefree operation of a ship & # 39 ;. She didn't drink or drink drugs at the time, the police confirmed.

Prosecutors initially said that Linda was facing 18 months in prison and a $ 1 million fine, but because the charge against her is not a criminal charge, she will be fined if she is found guilty.

The O & # 39; Learys have an estimated net value of $ 400 million. The couple were married for 29 years, although they were divorced between 2011 and 2013.

After finding out that Linda would not face time behind bars, Brito & # 39; s parents, Rosa and Antonio Ragone, and sister Paula Brito filed an unlawful death process against the O & # 39; Learys.

Poltash and Brito were on Ruh's boat during the crash together with two others who were injured.

Authorities said Poltash died immediately when the smaller Kevin O & Leary ship hit theirs and hit him in the head.

Brito suffered serious injuries and died in a hospital two days later.

A source associated with the owner of the larger boat claimed that O & Leary's boat had fled the scene after the collision, but a representative from the Shark Tank line-up said it was the other boat that created the scene left.

The representative of O & # 39; Leary further said that after the accident his wife received a DUI test and passed.
