Rod Stewart, 75, can be seen on film ‘Performing salute before punching guard’

Dressed in his distinctive golden lamé dinner jacket on New Year’s Eve, Rod Stewart delivered a blazing-fast right hook to a security guard at a chic Florida hotel, according to surveillance video obtained exclusively by DailyMail.com.

The footage shows that the altercation took place seconds after the 75-year-old singer mocked the guard who prevented him from accessing the children’s section of The Breakers Palm Beach.

Stewart seems to perform a salute with his right arm high above his head as he formed a mustache with his left pointer finger, a la John Cleese in Fawlty Towers.

He then seems to be hurling Jessie Dixon, the 33-year-old guard who claims he has been attacked by the duo and is expected to bring a civil lawsuit against Stewart and his 39-year-old son Sean about the incident.

The night ended with Stewart and Sean arrested and charged with a simple battery, a crime that could make them land for up to a year in prison.

The father and son did not plead guilty in January and their case must be filed Tuesday in West Palm Beach, Florida. Neither is expected to appear in court.

Dixon still has to file an official civil complaint against the two.

According to the surveillance video, which has no sound, the battle lasted about four seconds shortly after 10:08 am during preparations for the final countdown to 2020.

The images show how the singer arrives around 10:03 am with a large group near the Breakers playground. A check-in table was set up for a private party that would start later that evening.

The video shows Stewart’s group, including his wife Penny Lancaster along with their two boys, 14-year-old Alastair and Aiden, 8. Sean is initially seen in the background in a silver lame jacket.

The group is stopped at the table by a supervisor, the footage shows, but Stewart ignores the worker and starts walking around as if he is on a concert stage.

He then slides behind the servant and behaves like a gorilla that is about to grab her. As soon as she turns around, he stands with his hands in his pockets as if he had done nothing.

According to the incident report submitted to the court by the Palm Beach Police, the singer and his family were loud and argumentative when the caretaker said they had no access to the playground.

Dixon, in his black suit, arrives at 10:06 am in sight of the camera and Stewart and Sean, and an unknown man approaches him.

At that moment the discussion seems friendly. Stewart’s hands are down or in his pockets when several children from his group start playing on the small playground. He even places his left hand on Dixon’s shoulder, which does not seem to bother Dixon.

About a minute later, Stewart becomes more animated when Dixon holds on to his decision not to let them in. Dixon is pointed to the children on the playground as if they want to say they have to leave.

At 10:07 a.m., security images are briefly removed in a few steps before he returns to Dixon and mimics what appears to be a greeting and a finger-mustache.

The scene becomes ugly within 10 seconds.

Sean glides into Dixon’s personal space, which then places the back of his right hand on Sean’s chest, creating a personal boundary.

Sean, 39, then seems to be pushing Dixon back with both hands.

Stewart gets involved and apparently throws a filthy-looking hook to the right while Dixon gets ready and walks to Sean.

It is unclear from the images whether the fist of the rocker is connected to Dixon. However, the police report has Dixon claiming that the singer’s fist hit him on the left side of the chest.

The fight calmed down as quickly as it flared up with members of Rod’s party, including wife Penny, who played peacemakers.

The police report noted that Stewart apologized before leaving the area.

“It is clear that Rod would not get involved until he felt his son was in danger,” said a source at Stewart’s camp. “Rod was only trying to defend his boy. No jury in Florida will judge him for that. “

The famous father and his son have retained the powerful lawyer Guy Fronstin as their lawyer.

He has represented suspects in nationally covered crimes and hammer-to-hammer trials, including John Goodman, a polyclube owner who killed a teenager during a DUI crash, Michael Dippolito, the husband of a woman who tried to pay a hit man to kill he but eventually hired an undercover police officer, and Karyn Turk, a former Ms. Florida convicted of stealing the social security checks from her dying mother.

Fronstin called the incident a “misunderstanding.”

“This is an unfortunate situation,” said Fronstin. “I’m just glad nobody was hurt. It was all a big misunderstanding. “

Dixon’s lawyer, Gwayne Kelly, was not available for comment.
