Raymond Harris stabbed to death: Jarod James Miller walks free after being found not guilty in father’s death on Gold Coast in Surfers Paradise

A man has walked free more than three years after being charged with the murder of a young father on the Gold Coast, while two other men will face jail over the stabbing death.

The three co-accused had faced a lengthy trial in the Brisbane Supreme Court over the fatal stabbing of Harris, a 27-year-old father, at the popular Cavill Mall in Surfers Paradise on September 23, 2020.

The Crown had alleged that Jye Sebastian Webb-Italia, now 22, caused the fatal injury. A jury found him guilty of murder on Monday.

His 28-year-old brother, Jack Webb, was found guilty of involuntary manslaughter, while a third co-defendant, Jarod James Miller, 25, walked free after the jury found him not guilty.

Webb-Italia had pleaded guilty to involuntary manslaughter on the first day of the trial, but prosecutors did not accept his plea to the lesser charge.

Harris had died minutes after Webb-Italia stabbed him just once in the abdomen, severing his liver and stomach.

Webb-Italia was visibly emotional upon hearing the guilty verdict.

His older brother, Jack Webb, put his arm around his younger brother as he sat next to him on the dock.

Webb then had to turn his attention to listen to the jury as they handed down their own verdict. He was found not guilty of murder, but guilty of involuntary manslaughter.

The Crown had alleged that Webb and a third co-accused, Miller, 25, had aided or encouraged Webb-Italia to fatally stab Mr Harris.

The jury on Monday found Mr. Miller not guilty of murder or manslaughter.

During closing submissions, Mr Miller’s defense lawyer, Andrew Hoare, said his client had only used the gun defensively.

The trio had confronted Mr Harris outside the Surfers Paradise Beer Garden before being stabbed, the court previously heard.

The jury had been told Miller was also armed with a knife during the fight.

The man with the tattooed face walked out of Brisbane Supreme Court a free man shortly before 5pm on Monday, after spending almost four years in pre-sentence custody.

Webb-Italia and Webb will be sentenced Tuesday.
