Queensland man who chopped off giant penis on his parents’ lawn in crude message to brother discovers his fate

A man who cut a giant penis shape into his parents’ lawn to offend his brother has received a suspended jail sentence from a judge who branded him a serial pest.

The 44-year-old, who cannot be named for legal reasons, pleaded guilty to breaching a domestic violence order against his brother. in brisbane Arrest Court on Saturday for committing the crude act between February 16 and 20.

A prosecutor told the court the man saw an opportunity to leave the message for his older brother at his parents’ home in the suburb of Burbank, southeast of Brisbane, when he saw the grass was overgrown.

Because the defendant had disabled his parents’ lawnmower, the older brother was unable to mow the grass, the court heard.

Taking advantage of the opportunity, the man cut his brother’s name next to the shape of the penis to make the insult explicit, the mail reported.

He later insisted to police that it was “just a joke.”

However, he was charged with violating the domestic violence order that was issued on January 24 and violating a probation order.

Legal Aid lawyer Ann-Maree Russo told the court the man thought the stunt “would be taken as a joke” but now knew it was not a joke and had been done in bad taste.

“It’s clearly not a very well thought out plan, I suppose, to irritate your brother in this way,” Mrs Russo said, although she admitted it was a breach of a good behavior order.

Magistrate Michael Quinn told the man his history of breaching domestic violence orders made him “nothing less than a serial pest”.

Sentencing the man to a fully suspended two-month prison sentence, Magistrate Quinn said it was important that it was demonstrated to the community that the courts would enforce domestic violence orders.

He said the sentence would act as a deterrent to the man and anyone else who was “like-minded” from behaving in that way.
