Patagonia sues Nordstrom accusing the retail giant of selling thousands of knock-off ‘cotton’ merch

Patagonia has filed a lawsuit against retail chain Nordstrom, with the outdoor clothing giant accusing them of selling “thousands” of fake Patagonia sweaters and t-shirts in their stores.

They are seeking up to $150,000 for each “work” violated in the federal lawsuit, which was filed Tuesday in a California district court.

Nordstrom operates approximately 348 “Nordstrom Rack” locations in 41 states, meant to be a sister to the classic, luxury Nordstrom stores.

Patagonia claims Nordstrom is confusing customers and diluting their brand by selling counterfeits at Nordstrom Rack stores.

The brand and the retail company had ended an 11-year relationship to sell merchandise last year.

The lawsuit claims they “brought this issue to Nordstrom’s attention and requested that the company voluntarily recall products or refund customers” in an effort to avoid litigation.

However, Nordstrom did not recall the “fake and mislabeled” products and, furthermore, according to Patagonia, did not even “inform its customers that they had purchased counterfeits of inferior workmanship and quality”.

Patagonia says they are obligated to sue Nordstrom ‘to prevent further damage to [its brand] and consumers.’

They claim that it is an infringement of intellectual property rights and trademark infringement.

Patagonia is asking Nordstrom to recall all counterfeit Patagonia products sold.

If the lawsuit is successful, Nordstrom could be forced to stop selling its items and pay damages, according to msn.

A Nordstrom spokesperson told the Seattle Times that they are aware of the lawsuit and are looking into it.
