An NSW man who said he was spurred on by rapper Jay Z stabbing his father to death has not been found guilty of murder for a mental illness.
Matthew Spencer, 27, was ordered by Peter Hidden, a Supreme Court judge, to be held on Thursday until he is deemed fit to be released into society.
Spencer admitted that in September 2018 he stabbed his father, Shane Spencer, at their home in Trundle, near Parkes, with a serrated steak knife in his head, neck, chest, back, and arms.
Although he was deemed fit to appear in court, his lawyers argued that he should not be found guilty for a mental illness, a statement agreed by Crown Prosecutor Liam Shaw.
Acting Justice Hidden felt that Spencer – a diagnosed schizophrenic – should be held until a court decides that he no longer poses a danger to the public.
A report by a forensic psychiatrist filed with the court stated that at the time of the murder, the suspect “was working under such a lack of reason as a result of a mental illness, that he did not know the nature and quality of the act he committed.”
The report found that Spencer “didn’t know it was wrong.”
Between 2016 and 2019, Spencer was regularly hospitalized for treatment for “ psychosis-based religious delusions. ”
He also “showed paranoid religious ideas about Jesus, Lucifer and the devil” in the months before he left his father to die in a pool of blood.
His mental illness was likely exacerbated by years of substance abuse and use of amphetamines, the court heard.
Immediately after the incident, he posted a series of bizarre social media posts, including: ‘Trust God. It is written in the stars. No satellite can change this. I’m sorry again. But I shouldn’t show love. Love will kill you. ‘
He went to the nearby Trundle Hotel where he drank and smoked and was seen with blood on his face and clothes.
He then used the Trundle police station phone to call officers to tell them he stabbed his father – claiming he was being spurred on by American rapper Jay Z.
“Gangsta rap prompted me. The Jay Z Encore, the song that made me do it, “he told them.
