Kaylee Gain, a Missouri schoolgirl, can hold “limited conversations” but can’t understand why she’s in the hospital as her lawyers are forced to admit that posts made by her alleged attacker were false.
Kaylee, 16, of St. Louis, was initially abandoned in a life-threatening condition by Maurnice DeClue, 15, who repeatedly slammed her head into the concrete during a violent altercation.
She suffered a fractured skull and damage to her frontal lobe during the violent March 8 fight that was caught on camera near her high school, but has since been released from the intensive care unit.
An attorney for her family revealed that Kaylee has been able to engage in “limited verbal conversations” and has taken some short walks with the help of hospital staff.
Kaylee’s parents have harshly criticized their daughter’s accused attacker, who is in custody, and are demanding that she be tried as an adult.

DeClue’s parents reportedly told local media that she “wants to apologize” to Kaylee, ahead of a court hearing on Monday.
They initially targeted social media posts they believed were made by DeClue, which referenced WWE and made light of the situation.
However, Bryan Kaemmerer, who represents Kaylee’s family, was forced to retract the claims made in his earlier statement, admitting: “It appears that social media posts that were made from an account bearing the name of the accused do not appear to be legitimate. in light of additional details that have emerged regarding the timing of the defendant’s arrest, the defendant’s lack of access to her phone after being detained, and metadata showing precisely when these posts were first published.
He added that Kaylee is recovering but “tends to repeat the same short phrases over and over again” and that he doesn’t know why she is in the hospital.
DeClue’s parents reportedly told local media that she “wants to apologize” to Kaylee, ahead of a court hearing on Monday.
They have been visiting DeClue while she remains in juvenile custody and say police have responded to messages on social media that allegedly include threats toward the teen.
Their statement said Kaylee’s family was “heartened” after DeClue’s parents said she wanted to apologize for her actions before her court hearing on Monday.
“While these statements do not change the family’s position that it is appropriate for the defendant to be tried as an adult, it is encouraging that the defendant appears to be remorseful for what occurred during these unfortunate events,” he added.
‘The family is grateful that the accused apparently did not post these totally unpleasant messages.
“However, this does not change the fact that the family firmly believes that there is more than enough evidence for the defendant to be tried as an adult.”
DailyMail.com revealed that DeClue’s family said “cruel” people got their fundraiser for legal fees canceled and that the 15-year-old is the real victim.
During a hearing in St Louis County Court on Monday, officials set a date for DeClue’s certification hearing of May 10, which will decide whether she is tried as an adult on charges of first-degree felony assault.
Both sets of parents attended the hearing, and the judge informed DeClue’s parents, Ronald, who attended court in a wheelchair, and Conseula, that they have the right to an attorney, as does their daughter.
Gwendolyn, DeClue’s aunt, said “cruel” people got her fundraiser for legal fees canceled and that the 15-year-old is the real victim.
DeClue’s Aunt Gwendolyn Claims Family’s CashApp Fundraising Account Has Been Deleted Over Reports of a ‘Scam’
DeClue’s aunt wrote on Facebook: “People are working very hard to oppose our family” after her CashApp account was reported as a scam.
Both declined to comment when approached by DailyMail.com, but DeClue’s attorney, Gregory Smith, added that she was “doing well” despite being detained.
“She’s a smart girl,” Smith said. “We are doing everything we can to protect her, but she knows the law well.”
Judge Dodson ordered both families to be escorted out of the courtroom separately, which he said was standard practice in his courtroom. A pretrial management hearing will also be held on May 1, nine days before the certification hearing.
DeClue’s family, who confirmed her name publicly in a statement to “address misconceptions” surrounding her arrest, launched a fundraiser to raise $150,000 to help her with her legal fees after she was charged with felony assault.
A GoFundMe was removed from the site for violating its terms and conditions, but DeClue’s aunt Gwendolyn now claims her CashApp was also removed due to reports of a “scam.”
In a social media post, he said: “People can be very cruel and they have worked very hard and got CashApp removed this morning.”
‘Some say it was a scam. It wasn’t a scam, it was legit. If you would like to help with my niece’s legal support, please contact us. Her help is really appreciated.’
The fundraiser, which was taken down by GoFundMe, said the teen was “unfairly” portrayed as a bully and that she is the victim “in a complicated situation.” She raised almost $3,000 before being withdrawn.
The page was created on March 16, asking for help with her legal defense against the case, as her family claims they have received “racist death threats.”
DeClue’s relatives say she “deserves amnesty and a chance at forgiveness,” adding that her “fair trial hearing is being influenced.”
However, Kaylee’s family has responded to these claims, saying they are attempts to “minimize” the defendant’s actions, suggesting that being in the choir and being “multilingual” makes her incapable of committing the violent act.
Speaking exclusively to DailyMail.com, DeClue’s aunt claimed she was an honor roll student at Hazelwood East High School with an exemplary record and was “defending herself” during the fight with Kaylee.
They have been visiting DeClue while she remains in juvenile custody and say police have responded to messages on social media that allegedly include threats toward the teen.
Her relatives created a petition on Change.org, asking the St Louis Juvenile Court to show “compassion” towards the schoolgirl, DailyMail.com previously revealed.
Missouri Attorney General Andrew Bailey previously warned that the brutality was the result of an obsession with woke DEI policies and the soft approach to justice under former St. Louis District Attorney Kim Gardner and the current Rep. Cori Bush, a hardline progressive Democrat.

A Change.org petition asks the St. Louis Juvenile Court to show “compassion” toward the schoolgirl.
So far, more than 460 people have signed the statement, which states that the incident “was used to define her character and incite racial divisions and political conflict, and the Prosecutor’s Office is asking the courts to charge her as an adult.”
The petition is addressed to Youth Affairs Director Rick Gaines and needs 500 signatures to bring the matter to his office.
However, a spokesperson told DailyMail.com that only the judge presiding over the case can rule whether the teenager is charged as an adult, not Gaines, and the court cannot comment further.
Kaylee’s family says they want “justice through the legal system,” but pleaded with other teens not to retaliate against her alleged attacker.
Video of the incident circulated on social media showing another girl slamming the teen’s head into the concrete after throwing multiple punches at her, sending her to the ground.
Kaylee appeared to begin having a seizure as groups of other teens fought a few feet away.
Police found the girl suffering from a serious head injury near the intersection of Norgate Drive and Claudine Drive, about a five-minute walk from the high school campus. She was taken to the hospital and remains in critical condition.
