An Assistant Attorney General who prosecuted a former Central Michigan University Student for indictment for sexual violence resigned after having an improper relationship with one of the victims in the case, officials confirmed Tuesday.

Assistant Attorney General Brian Kolodziej resigned Friday, the office spokesman, Kelly Rossman-McKinney, unveiled earlier today, confirming in the media that Kolodziej had relationships with a victim of the Ian D. Elliot case.

Kolodziej, 41, chaired the persecution of 24-year-old former president Elliott, in which former classmates Rachel Wilson and Landrea Blackmore claimed that Elliott had sexually abused them.

Although it is not specified which of the victims Kolodziej was involved with, the relationships reportedly lasted from April to August of this year – before, during and after the trial of Elliott.

& # 39; I want to be sure that all the defendants in his cases have received the correct procedure and nothing that has contaminated Mr. Kolodziej, & # 39; Nessel continued.

The Attorney General's office will now review all of Kolodziej's previous cases to determine whether other cases of improper relations with victims or prosecutors have taken place.

"It's a sad day for the public prosecutor everywhere," Joe Barberi, Elliott's lawyer told the Morning sunshine. & # 39; Throughout the entire country, throughout the state. & # 39;

Barberi added that he had a short conversation with Elliot and his family on Monday evening, and will soon have another conversation with him about what can happen next.

Elliott did not argue in any competition for a single count of third-degree criminal sexual misconduct in June, after he had made a deal with prosecutors, imprisonment for one year and imprisoned 15 days.

He was confronted with two trials, one in which he was charged with two counts of third-degree criminal sexual behavior and assault with the intention of committing criminal sexual behavior. In that trial, which took place in July, Rachel Wilson was involved as his prosecutor and claimed to have attacked Elliot on August 31, 2016.

The second trial concerned Landy Blackmore, also a former student at CMU, who accused him of once counting criminal sexual misconduct in the third degree.

Both victims made passionate statements when Elliott was sentenced. Kolodziej assisted them both everywhere and praised them as & # 39; brave, heroic survivors & # 39 ;.

Kolodziej said that the treatment they have undergone makes it clear why so few victims of sexual violence are coming forward, with special emphasis on defense questions when Wilson and Blackmore were witnesses in earlier court hearings.

"Rachel Wilson provided the blueprint for rape survivors: fight until your voice is heard, demand honesty," said Kolodziej, according to Michigan Live.

Elliott's plea included the dismissal of Blackmore's case without a chance to revisit the case, while Wilson's case was also reduced to just a third degree.

With his plea not to dispute, he was able to accept the punishment without confessing guilt. He was also instructed to pay $ 198 in fines and costs.

The Attorney General's office filed his first three charges against Elliott in December after the Public Prosecutor of Isabella had rejected their case.

A preliminary investigation in February ended with Elliott, who had to be tested.

The Attorney General's office said that witness statements at that hearing led to the issue of a third-degree criminal sexual behavior in March – the charge against Blackmore.

Kolodziej joined the Attorney General's office at the end of 2018, having prosecuted sexual crimes in Macomb County since graduating from law school in 2013.

Prior to his career in law, Kolodziej had tried to pursue a career as an actor, who appeared as Derek in the 2004 comedy, The Girl Next Door.

The other cases that Kolodziej prosecuted for the state and Macomb County will now be reviewed.
