“The bottom line is that Mr. Avenatti has run out of money and is facing a complex lawsuit that can take up to six weeks,” Steward wrote in the federal filing.

Avenatti, who became famous as porn star Stormy Daniels in lawsuits against President Donald Trump, has recently been the home of a friend in California after being released from the Metropolitan Correctional Center in Manhattan due to coronavirus fears, but he’s still facing three ongoing criminal cases.

Steward represents Avenatti more than a year after he was previously represented by federal public defender attorneys.

Now that Avenatti’s funds are up, he proposes to keep Steward as his counsel, using funds set aside to help poor clients, according to the New York Post.

“The commission is long overdue and the defendant has no money to pay the lawyer,” Steward said. “Such an arrangement would save a lot of taxpayers’ money, then start over with new … advice.”

It is not clear when a Los Angeles judge will decide James Selna on this.

The 49-year-old is currently locked up in his friend’s tiny apartment in Venice Beach, near Los Angeles.

Avenatti was given a 90-day temporary release after receiving a $ 1 million bail from the Metropolitan Correctional Center in New York in April.

Judge James Selna ruled at the time that Avenatti could not own or use digital devices that allow Internet access.

Avenatti had been incarcerated since mid-January when a judge withdrew his bail and sent him to prison while he awaited his federal trial for attempting to extort Nike for $ 25 million.

He was convicted of the charges on February 14, 2020 and was held in a federal detention facility in New York City awaiting a June conviction for the Nike case.

He also faces criminal charges in New York, charged with defrauding former client Daniels and in Los Angeles for defrauding multimillion-dollar clients and others. In both cases, he has denied wrongdoing.
