Judge Stephen McDonald said the case would depend on whether “the aspect of the orders” met the legal standard outlined by the High Court.
Paul d’Assumpcao, a lawyer for the AFP and Services Australia, argued the terms of the order were “well within the threshold of what is acceptable to the courts”.
He disputed her characterization that the allegation stated in the warrant was not sufficient and said the warrant provided more information than the Penal Code requires.
He also argued that the courts had recognized the need to provide investigative agencies such as the AFP “sufficient flexibility” in the way they investigated alleged criminal offences.
“At some point you have to strike a balance,” he said.
‘At what level do we cross the line and say that (the information provided in a court order) is good enough?’
Judge McDonald said an order did not need to offer the particularity of an indictment and that the complexity of the case arose in “how to draw the line” on what was required in an order.
Stacey was not charged with any crime and there is no allegation of any crime on her part.
Judge McDonald said he would “reserve his decision” and would deliver it at a later date.
Speaking to NewsWire earlier this year, Stacey said she would sue the government for damages if she won her case.
“I haven’t been arrested and nothing has come of this,” he said.
