A Venezuelan migrant who shot a police officer in Texas was set to be deported to his home country, it has been revealed.
Jorge Chacón-Gutiérrez, 25, crossed illegally into Eagle Pass, Texas, in November 2023, with nearly 600 other migrants.
At the time, border agents were processing him for “expedited removal,” but he argued that he feared persecution if he returned to Venezuela, so he took his case to an asylum officer. an unidentified source from Homeland Security he told the New York Post.
The asylum officer denied his request and continued to process him for deportation.
But Chacón-Gutierrez then asked to present her claim before an immigration judge, who quickly vacated her deportation order and let her case proceed.

The Homeland Security source said the case highlights how the U.S. immigration system has “so many loopholes,” as police say Chacon-Gutierrez opened fire on three police officers who responded to a domestic violence call at an apartment in San Antonio.
Police said they responded to the apartment around 3 a.m. Sunday after the shooter’s girlfriend was assaulted by him, the police department said.
“When officers entered the apartment, (the shooter) was lying in bed with a rifle next to him, and began shooting at the officer.” Police Chief William McManus he told reporters.
“Officers returned fire and left the apartment.”
SWAT officers later entered the apartment and “saw that the suspect was deceased,” but McManus could not say whether it was a self-inflicted wound or whether the shooter had been hit by police bullets.
Officers responded to a domestic violence call in San Antonio around 3 a.m. Sunday.
The injured officer has not been identified by the department but is expected to survive.
Following Chacón-Gutierrez’s death, Texas Congressman Tony Gonzales said: “These are the consequences of failed capture-and-release policies.”
The department has not identified the injured officer, however, the chief added that he has been on the force for less than three years.
She underwent surgery on Sunday morning and is expected to survive.
Police have also not officially identified the shooter.
Meanwhile, US Immigration and Customs Enforcement (ICE) told DailyMail.com it is awaiting official confirmation of the shooter’s identity before it can reveal any details about how Chacón entered the country.
ICE is the federal agency responsible for tracking migrants in the U.S.
Police Chief William McManus confirmed the officer who was shot had been shot multiple times and underwent surgery Sunday.

Chacón was released into the United States after being given a notice to appear before a federal judge in April 2026. According to Fox News.
Following the death of Chacón-Gutierrez, Texas Congressman Tony Gonzales He said: ‘These are the consequences of failed catch and release policies.
“I am thankful that the injured SAPD officer is stable and I pray that he makes a full recovery soon,” he added.
