An illegal immigrant accused of raping a 16-year-old girl in Massachusetts was finally arrested by immigration authorities after a local district court ignored a request to detain him.

Boston’s ERO (Office of Enforcement and Removal Operations) has often criticized the state’s various liberal municipalities for allowing immigrants convicted of heinous crimes to be released despite their requests to keep them detained amid one of the largest immigration crises in the history of the United States.

The unnamed 20-year-old Brazilian national was arrested by Border Patrol on July 28, 2021 after he and his mother illegally entered the United States near San Luis, Arizona.

They were ordered to appear before a Justice Department immigration judge before being released on their own recognizance.

Even before his horrific child sexual abuse accusation, he had been in more trouble with the law after appearing in Massachusetts. He was arrested in August 2023 for operating a motor vehicle without a license. Those charges were later dismissed.

In December, an arrest warrant was issued for him in the city of Milford for raping a child and enticing a child under the age of 16, according to ERO Boston.

He was eventually found and arrested in Portland, Maine, about 140 miles north, on January 10, 2024. In addition to the rape charge, he was charged with being a fugitive from justice.

The man, whose name has not been identified by immigration officials, was taken to Milford District Court on Jan. 18, where he was arraigned on the charges and held on bail of just $5,000, although he would be required to wear a GPS monitor.

ERO Boston requested that he remain in jail, but the court ignored it and released the accused child rapist after posting bail.

He was finally arrested again near his residence in the city of Lowell on March 28.

“This Brazilian non-citizen is accused of sexually abusing a Massachusetts minor,” ERO Boston Field Office Director Todd M. Lyons said in a statement.

“Every second you spend roaming freely in our communities, you represent a potential threat to the children of our communities.”

“The men and women of ERO Boston will always prioritize public safety by protecting New England residents from heinous non-citizen criminals,” Lyons added.

According to ERO data, officers made 170,590 arrests in 2023, an increase of 19.5 percent from the previous year.

The agency recorded the arrests of 73,822 non-U.S. citizens who had criminal records: 108 were fugitives wanted by their governments for crimes such as homicide, rape, terrorism and kidnapping.
