Hilaria Baldwin was seen for the first time since prosecutors attempted to revive her husband Alec Baldwin’s manslaughter case in Rust.

The 40-year-old yoga instructor looked tense as she sipped coffee alone in New York City on Thursday.

She was wearing a white tank top and black running shorts, and was holding a drink in one hand while pushing her hair back with the other.

Keeping a low profile, the mother of seven strolled through the city streets in dark designer sunglasses.

The departure comes after a state prosecutor asked a New Mexico judge to reconsider dismissing Alec’s manslaughter charge in the 2021 fatal shooting of cinematographer Halyna Hutchins on the set of Rust, according to a court filing released Wednesday.

Special prosecutor Kari Morrissey argued that the July decision lacked sufficient factual basis and did not violate Baldwin’s due process rights.

State District Court Judge Mary Marlowe Sommer had previously dismissed the case mid-trial, citing that police and prosecutors had withheld evidence from Baldwin’s defense in the shooting that killed Hutchins.

The dismissal was made prejudicially, preventing the complaint from being filed again once the possible appeals have been resolved.

Baldwin, the lead actor in Rust, was rehearsing a scene when the gun he was holding went off, fatally wounding cinematographer Halyna Hutchins and injuring director Joel Souza.

The 30 Rock star claimed he pulled the hammer but did not pull the trigger before the gun went off.

The case was based on ammunition brought to the sheriff’s office in March by a man who claimed it could be linked to Hutchins’ death.

Prosecutors dismissed the ammunition as irrelevant, while Baldwin’s legal team accused them of hiding it, leading to a successful motion to dismiss the case.

In his request for reconsideration, special prosecutor Morrissey argued that the undisclosed ammunition was irrelevant and focused on Baldwin’s responsibility to follow gun safety rules.

“No one on the prosecution team… ever intentionally withheld evidence from the defendant, it simply did not occur to the prosecution that the bullets were relevant to the case even if they were the same or similar to the actual bullets found on the set of Rust,” Morrissey wrote, according to court documents.

He said defense attorneys knew about the ammunition but decided to forgo the opportunity to examine it before trial.

“This is a smokescreen created by the defense and was intended to influence and confuse the court… and it succeeded,” Morrissey wrote.

Baldwin’s attorney, Luke Nikas, said a response would be filed with the court.

In April of this year, Hannah Guttierez-Reed, the set’s gunsmith, was found guilty of involuntary manslaughter in Hutchins’ death and sentenced to 18 months in prison.

She is currently serving her sentence at the Santa Fe County Adult Detention Center and was due to be called to the stand to testify in the Baldwin case.

Since filming in 2021, filming on Rust has resumed, but has been moved to Montana under an agreement with Hutchins’ husband, Matthew Hutchins, who made him an executive producer.

The finished film has not yet been released for public screening.
