Actress Halle Berry’s long-running custody battle with ex Olivier Martinez continues, with both sides filing new claims in legal documents.
The 58-year-old actress was married to the 58-year-old French actor from 2013 to 2016, and they share a 10-year-old son, Maceo.
Berry claims Martinez is causing “prejudicial harm” to their son with her latest motion to delay an upcoming custody hearing.
Martinez, on the other hand, claimed last week that Berry is taking advantage of him by not allowing him time to prepare and by “trying to get an immediate hearing” to give him the “absolute minimum.”
Berry made headlines last week when she filed for sole custody of her 10-year-old son, Maceo.

The actress says her son is struggling at school and is “behind his grade level” and adds that he has been diagnosed with ADHD and mild dyslexia.
He adds that Maceo’s father is, ‘He is either ‘oblivious’ to her struggles or ‘carelessly ignores them’, which she says shows he is unfit for custody.
The actress claims that Martinez is delaying the custody hearing in an attempt to “get more money out of her.”
Martinez had previously said he needed an “expert” to testify on his behalf, which he called “absurd.”
“It would be unfair, and certainly prejudicial to Maceo, to continue the September 10, 2024 hearing for 120 days on the basis that perceptive third-party witnesses are expected to testify or that Olivier somehow needs to engage other, unnamed experts,” the documents read.
Shortly after Berry’s appearance, Martinez responded that the actress “refuses” to set a date that suits her.
He added that Berry has rejected his request for help paying his legal fees, even though “It is true that he is earning several million dollars right now.
The French actor insists that Berry is “preventing him from defending himself as he had neither the time nor the money to attend to her extreme request,’ adding that she ‘is not allowed to take advantage of (him).’

She adds that Maceo’s father “either doesn’t notice” her struggles or “carelessly ignores them,” which she says shows he’s unfit for custody.
Martinez also says that “he cannot be forced to waive his right to discovery or his right to sufficient time to prepare his response simply because (Berry) is trying to coerce and compel him to submit.”
In early August, Berry filed a petition for sole legal custody of Maceo, though she added an “alternative” that would give her “decisive authority to make all decisions” about his education, health and therapy needs.
Martinez also says that “he cannot be forced to waive his right to discovery or his right to sufficient time to prepare his response simply because (Berry) is trying to coerce and compel him to submit.”

Berry’s filing says she is trying to address her son’s “educational challenges” and added that she “struggled to obtain tutoring, an educational evaluation, and find an environment that was suitable for Maceo’s needs.”
The filing added that Martinez is “opposed, inflexible and has denied his consent for years.”
