Halle Berry has claimed her ex-husband Olivier Martinez is trying to delay their co-parenting therapy to “take the summer off,” a year after their divorce was finally finalized.

The Oscar winner, 57, married Martinez, 58, in 2013, the same year they welcomed their 10-year-old son Maceo, and separated in 2016. Their divorce was finalized seven years later in August 2023.

The couple agreed to attend therapy in May to “resolve disputes and conflicts between them in an effort to successfully co-parent” their son, but according to court documents obtained by TMZBerry claims her ex decided to delay the sessions until September so he could take the “summer off,” without consulting her or her therapist.

She says she missed the July sessions to travel to her native France and wants to cancel the August sessions because of her brother’s visit.

The actress wants a judge to force her to comply with the schedule established in the agreement.

She also says that since therapy sessions are conducted via Zoom, Martinez cannot use the trip as an excuse.

The star said the six joint sessions were due to be completed by June 14.

DailyMail.com has contacted representatives for both for comment.

In May it emerged that the former couple would seek the help of an adult and child psychiatrist in an attempt to resolve their issues, according to court documents obtained by We weekly.

The physician “will determine the form, structure, session length, and frequency of co-parenting therapy/coaching,” according to the documents.

The couple had planned to attend one session alone, before attending at least six sessions together before June 14.

Berry’s boyfriend Van Hunt, 54, could also be involved, as the documents reveal the singer “is not prohibited from participating in (her) co-parenting therapy/coaching sessions.”

Halle, who began dating Hunt in September 2020, finalized her divorce from Olivier in 2023.

She split from the Unfaithful actor seven years earlier, after just three years of marriage. They had a prenuptial agreement, but there were still plenty of unresolved issues.

At the time a source said We weekly‘Van has been very supportive of Halle throughout this entire process with her divorce.’

“But at the same time, Halle is an incredibly intelligent woman and can handle things on her own. Of course, it’s amazing to know that Van has her back and that she feels like she’s finally found someone who treats her with the respect she deserves.”

Halle and Olivier had ‘some unresolved issues regarding custody and child support’ of their son, which led to the case being stuck in court, according to TMZ.

But in 2023, the exes agreed to a formal custody and child support agreement.

The Oscar-winning star now has “joint legal and physical custody of Maceo,” the site said.

And she has to pay Olivier a whopping $8,000 a month, on top of Maceo’s health insurance, therapy and school expenses.

Halle has custody of Maceo from Monday to Wednesday and Olivier has custody from Wednesday to Friday, the site said.

If there are school closures, changes will be made.

The couple alternates custody of Maceo on weekends, TMZ added.

He will also write a check for an additional 4.3 percent of all income he receives above $2 million, the site added.

And there are several other expenses on top of that.

Halle must also cover Maceo’s private school tuition and all of his other activities, such as his soccer expenses.

And Berry will pay for Maceo’s medical and dental insurance and additional expenses.

The beauty will also pay for any therapy her son receives.

Halle and her daughter, Nahla, 16, whom she had with ex-boyfriend Gabriel Aubry, 47, will be allowed to attend the family sessions, the site said.

Martinez met Halle on the set of Dark Tide, which was filming in South Africa in 2010, the same year she and Aubry announced their split.

Things moved quickly for the glamorous couple, who confirmed their engagement in March 2012 and tied the knot in France just a year later on July 13, 2013.

In October of that year, three months after getting married, they welcomed a son: Maceo.

This is the third failed marriage for Halle, who was married twice before tying the knot with Martinez; she never married Aubry despite sharing a child with him.

In a joint statement, Halle and Martinez announced: “It is with heavy hearts that we have made the decision to divorce.

‘We move forward with mutual love and respect and with the common goal of doing what is best for our son. We wish each other happiness in life and hope that you will respect our privacy and, most importantly, that of our children, as we go through this difficult period.’

They had been feuding over the January 2015 incident at the Los Angeles airport, where Olivier hit airport employee Ronaldo Owens with a car seat, pushing him to the ground. Halle and their son were also there. A $5 million lawsuit was filed against Halle and Olivier in mid-October over the attack.

This “exacerbated their conflicts,” it was reported.

In addition to Maceo, Halle is also a mother to a daughter, Nahla, 16, whom she had with ex-boyfriend Gabriel Aubry, 47. The couple split in 2010; seen in 2009 in New York City.

“They have different personalities,” the site also said. “They are very, very different people. He is a very macho guy and things just didn’t add up.”

The two made headlines in 2012 when they got into a fight with her ex, Aubry, over Thanksgiving. The model had dropped off her daughter Nahla at Berry’s home in Los Angeles.

That’s when Martinez and Aubrey began to argue verbally, which soon escalated into a physical fight. Aubrey claimed the SWAT actor threatened to kill him. Both men had to go to the hospital for their injuries.

Aubrey was arrested and issued a restraining order as a result of the incident.

Berry was also previously married to David Justice from 1993 to 1997 and Eric Benét from 2001 to 2005.
