Guy Sebastian lets off some steam on the golf course amid embezzlement trial

Guy Sebastian capped off a stressful week on Friday with a few rounds of golf with friends at Sydney’s The Lakes.

The singer, 40, expressed frustration on the green as he nears the end of a messy lawsuit involving his ex-manager Titus Day, who is accused of embezzling nearly a million dollars from his star client.

Sebastian dressed the part in a fleece and cap, which he paired with white pants.

Sebastian’s former manager was found not guilty on Thursday of three of the 50 charges of embezzlement ordered by the judge as the trial nears completion.

Titus Emanuel Day was charged with embezzling nearly $900,000 from the pop star, but Judge Timothy Gartelmann ordered the NSW District Court jury to find not guilty on three counts related to nearly $15,000.

After his attorney Dominic Toomey SC said the defense did not provide evidence, the trial was adjourned until Tuesday, when prosecutor David Morters SC is expected to begin his closing speech.

The judge told the jury that the accused had exercised his right to remain silent and emphasized that it was up to the Crown to prove his case.

The 49-year-old manager pleaded not guilty to 50 charges of fraudulent misappropriation of money allegedly owed to Sebastian through royalties and performance fees

Day, who ran Sebastian through his company 6 Degrees between 2009 and 2017, also denied 50 alternative thefts.

In addition to ordering the jurors to acquit Day of three charges of embezzlement, the judge ordered them to acquit him of the three corresponding alternate charges.

“There was simply no evidence at all that the accused committed the act that would be one of these offences,” he said.

The judge also predicted that at the end of the trial he will order them to return a not-guilty verdict on all remaining alternative charges.

He told them this now so they can ignore them and focus on the remaining eclipse when they retire.

Judge Gartelmann emphasized that this did not mean he had any view on the strength of the Crown case, and said his decision related only to lawsuits.

The jury was told of a “bitter and hostile” rift between manager and musician, before Sebastian filed a civil lawsuit against Day in July 2018, when he found out he owed him money.

Two years later, he went to the police when he was alleged to have discovered ‘criminal behaviour’.

But Mr Toomey has stated that his client had an answer to every charge and suggested that authorities may have been tempted by Sebastian’s high profile.

Day told police that the pop singer owed him $1.2 million in outstanding commissions.

‘Why isn’t he being arrested for fraud, for not paying commissions? I don’t understand,” he said in the July 2020 interview for the jury.
