A security guard who took a three-year-old girl into a stairwell at a shopping mall in Sydney and masturbated for her was found guilty in a second lawsuit.

Mohammad Hassan Al Bayati reportedly took the child from a homebush mall playground in December 2016, where she was left unattended with her older sister while their mother went shopping for Christmas.

He then masturbated for her for 11 minutes, the court heard.

Al Bayati argued in his first lawsuit not to be guilty of holding a person for sexual gain and to commit an act of aggravating indecent behavior against a child.

The then 29-year-old claimed that he had tried to reunite the girl with her mother and took her to a toy store on a higher floor.

He claimed that the young girl had refused to move while the couple were in the stairwell, and that is why they were alone for so long.

Al Bayati said he did not know at that time that taking the toddler into a stairwell without CCTV cameras through an emergency exit door that had no hold on the inside was against the protocol because he had not been trained in such procedures.

In his first trial in June 2018, a jury could not pass judgment, but earlier this month he was found guilty by a judge.

Al Bayati & # 39; s bail has continued and he will appear again for a conviction next month.

Al Bayati was found guilty in his second lawsuit, after a jury was unable to reach a decision last year. He will remain on bail until next month when he will be sentenced
