A federal judge reserved his decision in the deportation case of the truck driver who caused the deadly Humboldt Broncos bus crash.
Jaskirat Singh Sidhu’s lawyer argued that Canada Border Services Agency (CBSA) officials who recommended her deportation did not take into account her clean record and remorse.
Lawyers for the federal Justice Department say the agents gave detailed reasons for their decision.
The CBSA has recommended that Sidhu be handed over to the Immigration and Refugee Board to decide whether he should be deported to India.
Chief Justice Paul Crampton said he would prioritize publishing a decision because of the seriousness of the Humboldt case.
If Sidhu is successful, the matter will be returned to the Canada Border Services Agency for another review.
Sidhu was sentenced in 2019 to eight years after pleading guilty to dangerous driving causing death and bodily harm in the Saskatchewan crash that killed 16 people and injured 13 others.
Court previously heard that the rookie trucker from Calgary, a recently married permanent resident, ran a stop sign at a rural intersection and walked into the path of the bus carrying Humboldt Broncos players and staff in 2018.
