The family of a Portland girl has filed a $9 million lawsuit against a public school district after two boys allegedly “gang-raped” the girl in a school bathroom stall.
Last month, the family of the unidentified 9-year-old girl filed the lawsuit in Multnomah County Circuit Court, alleging that both the district and a nonprofit after-school program failed to protect the girl.
According to the lawsuit, in April 2022, two male students in the Schools Uniting Neighborhoods program, at Scott Elementary School in Northeast Portland, told the girl that they would ‘find out where she lives’ if she did not tell staff she needed to. to use the bathroom.
She obeyed and went to the bathroom, while the other students followed her, locked her in a cubicle, took off her pants and each one ‘forcibly penetrated her,’ states the lawsuit, reviewed by Oregon livehe claimed.
While she tried to protect them, the children made it impossible for her to escape as they took turns blocking the doors, according to the documents.

The father of one of the children reported the incident and his son and the other child were suspended for only one day, according to the lawsuit.
Prior to his suspension, instead of involving police in the alleged sexual assault, “PPS staff conducted their own internal investigation,” according to the lawsuit.
The staff also interviewed the girl without telling her parents, relatives or legal representatives, according to the lawsuit.
According to court documents, six days after the alleged assault, the victim’s father took her to Randall Children’s Hospital for an evaluation.
A week after that visit, she was seen at a child abuse program called CARES Northwest, where medical staff were informed about the incident and concluded that “the history provided was very concerning for sexual abuse,” the lawsuit says.
According to the legal document, since the alleged attack, the young woman has been suffering from the pain, trauma, lack of education and social anxiety caused by the incident.
The father of the nine-year-old boy proceeded to transfer his daughter and youngest son to another school, which took a month and disrupted his children’s education, according to the lawsuit.
The lawsuit also noted other alleged cases in which male classmates at school put the girl in similar situations.

DailyMail.com has contacted the Portland Public School District, the Sun Community Schools program and Scott Elementary School for comment.
Sydney Kelly, spokesperson for Portland Public Schools, told Oregon Live, “The district learned of these new allegations last week when we received the lawsuit and we are investigating.”
“We are mandated reporters, which means we must report any cases of possible child abuse and neglect.”
“We take our responsibilities as mandated reporters seriously and follow the law regarding whistleblowing.”
The lawsuit accused the district and the after-school program of failing to educate students about sexual boundaries, failing to communicate with parents or guardians and failing to enforce rules about sexual conduct on school property.
