Drew Barrymore’s stalker Chad Michael Busto is released from prison for the second time after the hapless prosecutor says he can’t be held on bail because “it’s not an eligible offense.”
Busto, 43, was arrested Friday night after trying to break into Emma Watson’s dressing room during New York Fashion Week, but the creeper is already on probation after being charged last week with two counts of disorderly conduct, including one count of trespassing and one count of third-degree criminal trespass.
The move comes less than a month after Busto was released by a Southhampton judge after being arrested and charged with fourth-degree felony after stalking actress Drew Barrymore. Busto showed up at the star’s Hamptons home on Aug. 23, two days after confronting her during a live event at the 92nd Street Y.
Busto, who failed to show up for a fitting of his GPS monitor earlier this month, now has an active warrant for his arrest, a Suffolk County representative confirmed to DailyMail. com.
Social media users claimed Busto was known for targeting female celebrities, including Amber Heard. Someone named ‘C. Michael Busto was kicked out of a Facebook fan group of the actress for “sexual harassment,” “threats” and “stalking,” the Daily Beast reported.

Busto has a long criminal history, including an arrest in Santa Monica
Busto has “a lengthy criminal history, including an arrest in Santa Monica.”
He also had numerous arrests in Georgia, Minnesota, Florida and Wisconsin for disorderly conduct, trespassing and other crimes, according to Santa Monica Daily Press.
According to multiple police reports, Busto’s criminal record dates back to June 1999 and as recently as January 2022.
Among the crimes on his criminal record — spanning multiple states — were harassment, criminal trespass, resisting arrest, indecent exposure, disorderly conduct and theft, according to a report.
On August 21, Busto confronted Barrymore at an event at the 92nd Street Y during an interview with Reneé Rapp.
During the event, according to the New York Post, Busto shouted at Barrymore: “You know who I am!” I need to see you at some point while you’re in New York!’
Busto was restrained from the stage by an on-site guard as Rapp led Barrymore off the stage.
Two days later, hHe was taken into custody after trespassing on the talk show host’s nearby $6 million luxury estate in Sagaponeck.
Officials said he was seen roaming the Hamptons neighborhood looking for Barrymore’s home. The 48-year-old actress was not at the residence when she was apprehended, sources said.
At an Aug. 25 hearing in Southampton Town Justice Court, Judge Barbara Wilson released Busto — who was charged with misdemeanor fourth-degree stalking in the incident at his home — on condition that it is equipped with a GPS tracker.
During the hearing, Busto told the court he was bankrupt and seeking to live in a shelter. He said he is scheduled to appear at a Sept. 3 hearing in Texas in federal court.
Fourth-degree harassment is not a bailable offense.
On Friday evening, Busto was arrested again after searching for British star Emma Watson, 33, at one of the New York Fashion Week fashion shows. TMZ reported.
Busto allegedly entered a room at the Brooklyn Navy Yard located at 63 Flushing Avenue around 7:40 p.m., demanding to see the Harry Potter star who was crowded with models and makeup artists.
He shouted to onlookers pledging his love for the A-list celebrity.
“I want to marry Emma Watson. Let me talk to Emma Watson,” he reportedly said. “Let me take a picture with Emma Watson.”
Management called police, and Busto was taken into custody and charged with two counts of disorderly conduct, one count of trespassing and one count of third-degree criminal trespass, according to a complaint obtained by DailyMail.com.
Several fashion shows took place Friday at the Navy Yard, including that of the famous designer Ralph Lauren.
Although it’s unclear whether Watson was in the dressing room or at the fashion show during the ambush, the outlet reported.
The Brooklyn district attorney’s office said Busto was held overnight at a central booking facility after his arrest and was arraigned this week in Brooklyn court before his release.
Busto is represented by Jessica Kovac, an attorney with Legal Aid Brooklyn. And the Brooklyn Justice Initiative is handling Busto’s supervised release.
When DailyMail.com contacted Kovac, she did not respond to our request for comment.
A Suffolk County representative told DailyMail.com on Thursday that he was aware of Busto’s latest offense.
“Brooklyn is not in our jurisdiction and we were unable to prosecute the defendant due to misdemeanor bail laws,” a representative said.
They confirmed that the warrant for his arrest was still active.
Busto’s next court date is October 10 in Kings County Criminal Court in Brooklyn, for Watson’s case, The New York Post reported.

A source close to Barrymore said the actress was not shaken by the disturbing series of events.
“Drew feels good, safe, and even in the moment, it happened so quickly that she was fine and didn’t stress,” the source said. “She has moved on after the incident because she knows people were there to protect her.”
The source continued: “The only thing she didn’t want was for the incident to be the thing remembered for the night, so she forgot about it as soon as it was over, and she kept talking to Renee and getting back on topic. the focus on the conversation, that’s what was important to Drew.
“She’s not going to change the way she lives her life and protects herself, all of these things are and have been set for her throughout her life, and she doesn’t want anyone to worry about her well-being.
While it’s unclear what Barrymore’s reaction is following the latest Busto news, a source told DailyMail.com during last month’s incident that Barrymore was in good spirits and didn’t want to change his way of living after the scary incident.
