A former Nomads outlaw motorcycle gang member accused of unlawful sex with a 12-year-old girl he met at a Sydney train station has lost his bail bid.

The girl accepted Husa Hasanovic for a cigarette and told him she was 16 years old, his lawyer told the NSW Supreme Court on Thursday.

The 27-year-old steel fixer was sued in February for sexual intercourse with a child between 10 and 14 years old and opposed to arrest.

The police claimed that he had spoken to the girl at a train station and on a train before taking her to a house and sexually abusing her.

His lawyer Mustafa Agar took note of the defense of & # 39; & # 39; fair and reasonable error of fact & # 39; & # 39; which he said the Crown must prove otherwise.

While awaiting bail, prosecutor Raffaella Buttini handed over two CCTV photos of the girl as well as her interview with the police and said the alleged incident took place at 6:34 pm, not at school.

In refusing bail, Judge Richard Button said in his opinion that the interview image & # 39; a childish person and not a female & # 39; and that the crown on Hasanovic & # 39; not without strength & # 39; used to be.
