For this reason, Hindlip claims, he signed the agreement while “very ill” and “subject to [HCA]’sand [his] the influence of the surgeon on him”.
Worse things followed, according to Hindlip. His operation, which included replacement of his aortic valve and repair of two other valves, was “performed negligently” – it is alleged – with the result that he was “subjected to a prolonged post-operative recovery period as an inpatient.” “. in [HCA]’hospital’.
The documents indicate that Hindlip also intends to take action against his insurer and his surgeon.
HCA has submitted a detailed response to the Hindlip attack. Denying that his employees had said that the companion’s insurance company had approved the operation – and the post-operative care – he alleges that it was Hindlip “or her family” who said that the insurance company “had authorized the treatment.”
He also alleges that Kirstie informed staff that her father’s insurer would be “liable for 60 per cent.” [of costs]’ and his father for 40 percent.
Kirstie – HCA alleges – told staff, over the phone, that her father ‘had a dispute with [his insurer] and not with [HCA]’.
The company adds that Lord Hindlip had “plenty of time to read and understand” its terms and conditions.
