A New York man is suing Tesla, claiming that when he started one of their eco-friendly e-cars, it “suddenly and automatically” took off due to brake failure, causing him injury” serious and permanent.
Akm Shamsuzzaman, a rideshare driver for Revel, was working on Jan. 29, 2023, at the company’s dispatch garage in New York, where he was assigned a Tesla to drive that day.
According to a lawsuit filed Tuesday in New York State Supreme Court, he tried to start the vehicle with a key card, but it wouldn’t start.
He tried it a second time and the vehicle started immediately and accelerated forward, out of Shamsuzzaman’s control.
The driver tried to slam the brake pedal to no avail and led Shamsuzzaman to steer the car into an empty parking space and crash it. In court documents, the driver alleges he had to swerve to avoid hitting pedestrians.

Daniel Shimko, Shamsuzzaman’s attorney, said his client nearly bumped into a few people.
The lawsuit alleges that Shamsuzzaman suffered “serious and permanent” injuries as a result of the accident, although Shimko said The daily beast he was “not seriously injured”.
The vehicle he was driving is described by the suit as “unsafe” and “defective” and says Tesla “owed the plaintiff a duty to exercise reasonable care in the design” of the car.
“At all relevant times, [Tesla] failed to exercise due diligence in the design of the subject vehicle,” the lawsuit alleges.
Later, the lawsuit accuses Tesla of knowing that the car was defective when it was manufactured and that it was not built to specification.
Shamsuzzaman is asking for an undetermined sum, plus costs and fees in a jury trial.

They noted that it is “the largest public electric vehicle fast-charging station in North America, where our all-electric, all-employee ride-sharing service charges and operates from, serving the entire city. from New York”.
When pressed on the lawsuit, they declined to comment.
Although often hailed as the future of vehicles, Teslas are sometimes known to malfunction.
More recently, China recalled 1.1 million Teslas for brake issues in imported Model S, Model X and Model 3 cars, as well as Chinese-made Model 3s and Model Ys between 2019 and April 2023.
