The move comes a week after Avenatti, who has spent five years behind bars for defrauding former client Stormy Daniels out of millions and trying to extort $25 million from Nike, pleaded guilty in court to four counts of wire fraud and a tax-related charge. charge .

In a court filing, the US law firm said it “expects to dismiss the remaining counts of the charges after the sentence is imposed.”

Avenatti was initially charged on 36 counts in 2019, including bank and bankruptcy fraud.

Prosecutors said on Tuesday that they do not plan to try Avenatti on six of the remaining charges and asked the court to postpone the trial of 25 other charges until next year.

Authorities have said the 51-year-old attorney, who has been suspended from practicing law in California, has defrauded clients by negotiating and collecting settlement payments on their behalf and funneling the money into accounts he managed.

He is said to owe his customers $9 million in refunds, but Avenatti said he disagreed with the estimate and the amount is much lower.

Avenatti is currently serving a five-year prison term for convictions in two New York cases.

He was convicted of stealing book proceeds from Stormy Daniels, the porn actress who catapulted Avenatti to fame after representing her during her legal battles with President Donald Trump.

Avenatti represented Daniels in her bid to break a confidentiality agreement with Trump to remain her mother over an affair she said she had had.

He became one of Trump’s main opponents, attacking him via cable news programs and Twitter, and at one point considering challenging him in the 2020 presidential election.

Avenatti, who is in federal custody and representing himself in the case, made a plea at a court hearing in Santa Ana last week, where he admitted to cheating on his clients.

However, Avenatti disputes how much he stole.

The plea came after Avenatti filed papers with the court earlier in June stating that while he hadn’t made a deal with federal prosecutors, he wanted to change his plea to accountability and further embarrass his family.

“I have embezzled and misused certain of their settlement funds,” Avenatti told the court, adding that he believes the amount to be refunded is “drasically less” than the $9 million quoted by the government.

Prosecutors said the plea would subject Avenatti to a whopping 83 years in prison.
