Just days after Diddy was hit with a massive $100 million default judgment, the embattled music mogul is trying to fight it.
The 54-year-old rapper was sued by Derrick Lee Cardello-Smith for $100 million, alleging he drugged and sexually assaulted him at a party in 1997.
Since Diddy did not formally respond to the lawsuit or attend a virtual hearing that took place on Monday, the judge issued a default judgment against the rapper.
Starting October 1, Diddy would have to start paying monthly installments of $10 million to Cardello-Smith.
However, Diddy filed an emergency motion on Thursday to dismiss the judgment, alleging, among other things, that he never received the lawsuit.

His lawyers also strongly deny any wrongdoing, saying the allegations are “apparently implausible and completely fabricated.”
The lawyers also say that even if the allegations were true, the statute of limitations on those charges expired 17 years ago.
Diddy’s team claims the lawsuit is frivolous, as the man who filed it is a convicted rapist and they claim he has a history of filing frivolous lawsuits.
The lawsuit claims Cardello-Smith and Diddy were having sex with a group of women at a party in 1997, alleging that at one point, she felt Diddy’s hand touching her buttocks.
She also claims that Diddy put something in her drink and when she woke up, Diddy was having sex with another woman and she claimed he told her, “I did this to you too.”
Cardello-Smith, who is currently serving time in a Michigan prison, filed a restraining order against Diddy in August.
He provided records showing Diddy visited him in prison, alleging he offered Cardello-Smith $2.3 million to drop the charges against him.

Diddy’s lawyer Marc Agnifilo told DailyMail.com: ‘This man (Cardello-Smith) is a convicted felon and sexual predator, who has been sentenced on 14 counts of sexual assault and kidnapping over the past 26 years.
“His resume now includes cases of judicial fraud from prison, as Combs has never heard of it, much less been the subject of any lawsuit. Combs hopes this ruling will be quickly dismissed.”
Last month, Combs filed a motion to dismiss a $30 million lawsuit filed by record producer Rodney “Lil Rod” Jones, who sued him for repeated groping and possible drug-induced rape.
Jones filed the lawsuit in February, just weeks before federal agents raided two of Combs’ homes amid a sex trafficking investigation.
Jones claimed he was ordered to recruit prostitutes and have sex with them for the star’s pleasure, and has hundreds of hours of video documenting Combs’ “gross illegal activity.” Diddy has denied all allegations of wrongdoing.
