A municipal worker in a northern Victoria county is taking his employer to Federal Court after accusing him of illegally dumping toxic waste and punishing him for speaking out.

John Mangan, who has coordinated waste and recycling at Moira Shire for 12 years, alleges he was demoted and intimidated by his employer for speaking out against the inappropriate disposal of hazardous waste from a number of development sites.

According to her lawsuit statement, Mangan, who was in charge of upholding EPA standards, first complained about Moira Shire’s conduct in 2019 when cleanup began at the Rowe Street Drainage Basin project in Numurkah. .

The statement alleges that email correspondence between Mangan and Rowe Street project managers Paul Somerville and Kieran Wall shows Mangan was told to dispose of asbestos-filled soil at the site without taking it to the Cosgrove landfill. , where the county would. he has to pay.

Mangan claims that he was continuously pressured and that waste began to be dumped illegally at the Yarrawonga transfer station in March 2020. In April, he alleges, waste was improperly dumped at the Strathmerton and Tungamah transfer stations, which allegedly became contaminated. .

After Strathmerton and Yarrawonga began rejecting loads of contaminated concrete in May 2021, the statement claims the county began illegally dumping construction and demolition waste in a paddock north of the Yarrawonga station. Hazardous waste from the River Road and Gilmore Street gutter and gutter replacement project, which covers the Yarrawonga Showgrounds, also arrived at the site, the claim statement alleges.

Mangan says he told Moira Shire general manager Scott Draper in May 2021 that he had a duty to report the alleged illegal dumping. An investigation was allegedly launched into Mangan’s conduct, during which he claims he was not provided with details of his alleged misdemeanors or given an opportunity to defend himself.

During the investigation, he says, he was suspended under threat of dismissal. In March 2022, Mangan says he was told the county investigator found corroborating evidence of his alleged misconduct, and he was demoted without explanation.

Moira Shire confirmed that a claim had been filed against her, but a spokesperson said it was inappropriate to comment while the matter was before the court.
