Comedian Andy Dick, 56, NOT charged in alleged sexual battery case

Andy Dick will no longer face sexual assault charges after his accuser refused to cooperate with the investigation, authorities said.

The 56-year-old actor was charged with felony sexual assault at a trailer park in Irvine, California on May 11, when police in Orange County, California arrested him.

Orange County District Attorney’s Office found there was ‘insufficient evidence’ to charge the actor and sent the case back to the bailiff for ‘further investigation’.

Orange County Sheriff’s Sgt. Scott Steinle told DailyMail.com on Thursday that “after re-interviewing the alleged victim, the OC Sheriff’s Department decided to drop the case.”

“The victim did not want to participate in our investigation,” Steinle said. “Since the victim no longer wants to cooperate, the investigation will not continue.”

Steinle said that if the victim decides in the future that she wants to participate, then the case could be reopened.

After hearing the charges were dropped, Dick’s attorney, Daniel Kapelovitz, told DailyMail.com: “The minute I found out about the arrest, I knew there was no case. Nothing happened.’

Kapelovitz is also representing the News Radio star in another alleged sexual assault case set to go before a jury in Los Angeles next week.

The misdemeanor incident in which a Lyft driver accused the News Radio star of groping him during a car ride four years ago.

Dick pleaded not guilty and after a pre-trial hearing last Monday, the comedian told DailyMail.com that the April 2018 incident, in which the driver told police Dick had grabbed his genitals, “didn’t happen.”

Another hearing was held Friday at the Los Angeles Airport Courthouse and jury selection was due to begin Tuesday.

But that timeline could be pushed back as the deputy district attorney on the case has been ill and may not be able to return to court until next week.

Dick faces up to 180 days in prison if convicted at his jury trial.
