A woman who was arrested driving drunk and wearing leather lingerie when she collided with a man on an electric scooter has been sentenced for her “very, very bad decisions”.

She was wearing a tight black suit when she appeared at Sydney’s Downing Center Local Court on Thursday to be sentenced for drink-driving.

His lawyer told the court that Pham realized he was “at the proverbial fork in his life.”

He said she had moved back to Sydney to reconnect with her family, but had “relapsed into making some very, very bad decisions” at the time of the accident.

The court heard Pham had received a call from friends asking if he wanted to go out on the night of February 2, so he drove his car to Potts Point, in Sydney’s east.

She had a few drinks and decided it would be nice to drive herself home instead of staying with a friend or picking up her car in the morning, as she had originally planned.

“He made what he thought was a calculated decision, but in reality it was very reckless,” Pham’s lawyer said.

He maintained that this was not “a blatant disregard for the rules” but rather a miscalculation on his part.

However, Magistrate Susan Horan found there were “some difficulties” with that argument because Pham had been caught with a blood alcohol level that was almost double the limit.

“That filing carries more weight if it approaches the legal limit,” he said.

“This is already over.”

The court heard the 27-year-old had previously been convicted of another drink-driving offense in Western Australia.

“This is a problematic offense from the point of view of public safety and other road users,” Judge Horan said.

“I’m still worried about the reading and the fact that it’s his second time.”

He sentenced Pham to a 12-month community corrections order and disqualified her from driving for nine months.

When the 27-year-old lingerie lover is allowed to drive again, she will have to serve a two-year restraining order.

The interlock system requires the driver to breathe through a tube to ensure they have not consumed alcohol before being able to drive the car.

Pham did not comment as he left court Thursday and held papers in front of his face in an attempt to hide his face.
