A Bronx father has been sentenced to three to nine years in prison after he has been found guilty of murdering his son by choking him.
Claude Tinnin, 21, admitted to the police that he smoked marijuana and then covered the face and mouth of his eight-month-old son August in March 2018 with blankets and sheets in Rutgers Houses in the Lower East side of Manhattan.
Tinnin's girlfriend and mother of August, Antoinette Fleming, found the baby and rushed him to the hospital where he died of a cardiac arrest probably due to respiratory injury, according to court records.
He pleaded guilty to a second-degree homicide count in the Manhattan Supreme Court.

Tinnin confessed that he had completely covered the baby's head and mouth and then laid him on his stomach for a nap.
The boy had turned pale and blue by the time Tinnin's girlfriend found him and started screaming, according to legal documents.
Fleming had a warrant for protection against Tinnin at the time of their son's death after he allegedly struck her during a fight while she was pregnant.
The charges were later withdrawn, but Tinnin agreed to aggravate the criminal contempt for violating the protection order.
The couple has another child who has been taken out of their custody and placed under the care of an uncle.

Sta Ana argued last month for a prison sentence of one to three years for Tinnin.
Assistant prosecutor Nicole Blumberg argued at the hearing that less than three to nine years would not be suitable for the extreme carelessness that caused the child to die.
