Murderers Dellen Millard and Mark Smich have had their convictions upheld by Ontario’s highest court for the high-profile murder of Hamilton’s Tim Bosma.
It is the second of three murder convictions to be upheld against Millard, after the court also rejected an appeal against his conviction for his father’s murder.
But the three-judge panel agreed that the trial judge properly addressed the relevant issues and dismissed the appeals of both co-defendants.
At trial, prosecutors argued that Millard and Smich jointly planned to kill Bosma — a 32-year-old Hamilton father who was a stranger to them — and steal his truck on May 6, 2013, with evidence suggesting the men then gutted the truck. , hid the murder weapon and burned Bosma’s body.
The court will release its decision tomorrow on Smich and Millard’s appeal for the murder of Laura Babcock, the 23-year-old who prosecutors say was killed by the two men to settle a love triangle between her, Millard and his then-girlfriend . .
