Theresa Balboa was arrested by police on Tuesday based on a tip from her male companion, and charged with tampering with evidence in connection with the disappearance of the five-year-old boy.
Balboa was arrested in room 106 of a Best Western motel in Jasper, Texas, where the child’s body was found.
Thursday morning, the remains have not yet been identified as Samuel, but investigators believe it is the missing boy who would have turned six last Saturday.
According to court records cited by: KHOU11A man allegedly met Balboa in the parking lot of the Walmart in Cleveland, Texas, and picked her up in a pickup truck, along with the black plastic bin with a yellow lid.
The couple drove to the Best Western in Jasper, where they then entered the motel on surveillance video. Footage shows the man loading the plastic bin from his truck and carrying it to room 106 before leaving.
According to court documents, the same man placed an anonymous call to the Crime Stoppers tipline on Tuesday, providing information about the smelly bin and the location of the motel.
When officers arrived on the scene in response to that tip, they reportedly found the plastic container in the room and Balboa in the bathroom.

TIMELINE OF SAMUEL OLSON CASE:
30th of April: Samuel Olson, 5, last seen by anyone outside his family
May 8-9: Samuel’s paternal grandmother, Tonya Olson, says she spent the weekend with her grandson
27th of May: Theresa Balboa, girlfriend of Samuel’s father, Dalton Olson, reports him missing in Houston
1 June: Police in Jasper, Texas, receive anonymous tip that leads them to Best Western motel, where they find Balboa and later the body of a child in a plastic bin
“I told her, I said, ‘I’m so damn disappointed in you,'” Miller told KHOUE 11. “I said, ‘You know, every word you say is a lie.” And then things started to unravel, I guess.’
Balboa, who was on bail at the time as a result of a domestic violence incident, was the one who reported the child missing on May 27, although the boy’s last verified sighting was at his school on April 30.
Balboa claimed that Samuel’s mother, Sarah Olson, and a person dressed as a police officer showed up and took the boy out of the house.
Sarah Olson, through her attorney, said she did not know her son’s whereabouts, and that despite having primary custody of him, her father had been denied access to him since January 2020.
It has since been revealed that Balboa himself had custody issues.
Court records obtained by: Click2Houston revealed that Balboa lost custody of her two daughters in 2019 after failing to appear in court.
The father of Balboa’s children also did not show up and the children were given to a relative, who was appointed their guardian.
The woman told the station that Balboa was not taking good care of her daughters, who are now six and eight years old.
Samuel’s father, Dalton Olson (pictured with girlfriend Balboa before the grim find) said the six-year-old is his “whole world.” He has not been called a suspect
Sarah Olson, Samuel’s biological mother (pictured together, left), said through a lawyer that she had primary custody of the boy but hadn’t seen him since January 2020
“She wasn’t born to be a mother,” the guardian said.
Balboa is currently in jail in Jasper County, but she will be sent back to Houston to face the evidence tampering charge, but Houston’s assistant chief of police, Heather Morris, said at a news conference Wednesday that more charges are possible once a autopsy is completed.
Samuel’s family has spoken out after discovering the body believed to be his, revealing their devastation.
‘[I am] shocked and so many other things that words can’t explain right now,” Tonya Olson, the paternal grandmother, told CNN. “We grieve as a family. None of us can turn our heads around this. My son or anyone in our family had absolutely nothing to do with this.”
Miller, the founder of Texas Equus, said that after the discovery of the body, he was with Samuel’s paternal relatives and witnessed their heartache firsthand.
“It was just devastating there last night and seeing Dad go through all the pain and sorrow and everything he went through,” Miller said, referring to Dalton Olson, the boy’s father.
Assistant Police Chief Morris said Dalton Olson is not currently considered a person of interest in his death, but investigators continue to talk to him. So far, no motive has been revealed.
Samuel’s biological mother, Sarah Olson, has issued a statement through her lawyer demanding justice for her son.
“I don’t want people to forget Samuel’s name,” she said. “Please let the outside world know I have a broken heart, but I believe that body is my baby.”
Balboa reported that Samuel went missing on May 27 at the 8800 block of McAvoy Drive in Houston, as he claimed the boy had been taken by his birth mother and a person dressed as a police officer.

Police were unable to verify Balboa’s version of events.
The last confirmed sighting of Samuel was on April 30 at Holbrook Elementary School.
Samuel’s paternal grandmother claimed he was with her the following weekend, May 8-9, and she heard his voice on the phone just over a week ago.
On Monday, police executed a search warrant at an apartment where Balboa lived with a friend and seized her Dodge sedan.
Court records uncovered by Click2Houston indicate that Balboa was charged with assaulting a family member – respiratory failure in November 2020 after she allegedly strangled Dalton Olson.
Balboa was charged with assaulting a family member – respiratory failure in November 2020 after allegedly strangling Dalton Olson. Olson is said to have received a distress warrant against Balboa. The woman has been depicted in previous mugshots
Olson is said to have received an emergency order against Balboa, which prevents her from having direct contact with the victim or a member of his family.
When asked about the order prior to the discovery of the body at the motel, Olson said he and Balboa reconciled and that the choking incident had nothing to do with his son, who was not present during that altercation.
Olson further defended Balboa, saying she had helped him take care of his son while he was at work.
