At the request of an officer, Margera sat on the floor in the parking lot, and although his conversation with the officer was not heard, he was seen waving his arms and making violent gestures.

The arrest may have been preceded by some sort of family drama, as Margera’s estranged wife Nikki Boyd and their five-year-old baby Phoenix were at the restaurant, according to a witness at the scene.

However, the police did not clarify if he was arguing with his ex-wife, or if it was another woman.

The sources added that Margera will have to pay $500 for early bail, unless he chooses to stay behind bars until he sobers up.

Earlier that month, Margera was also arrested on domestic violence charges after police in California responded to his home in Escondido, where a woman alleged he had kicked her.

The alleged victim was not named, but it was Margera’s friend, Jessica, and not his ex-wife. It is unclear if the victim is in the most recent condition.

Margera was eventually released on $50,000 bail, though the local district attorney said no charges would be filed against him.

Boyd had filed for divorce from Margera in February of this year after claiming he had been inattentive while visiting his son.

She has asked for legal and physical custody of Pheonix, though she says Margera should still be allowed to have supervised visits with his son in the Los Angeles area.
