A woman who says she was gang-raped by men celebrating a money weekend had consensual sex with two members of the group shortly before the alleged rampage.

The woman, who was 18 when she first encountered party members at a pub in New South Wales’ Hunter Valley, gave evidence against the accused rapists on Friday.

Maurice Hawell, his brother Marius Hawell and their friend Andrew David have pleaded not guilty to a series of charges including aggravated sexual assault.

Three women, Miss A, Miss B and Miss C, told police they were subjected to sexual assault, but cannot identify which men were allegedly responsible.

Miss A and Miss B say they were raped at the same time in a rented apartment for a weekend, while Miss C says she was abused the following night.

Maurice Hawell, 30, and David, 28, say any sexual relations they had were consensual and deny engaging in certain acts, while Marius Hawell, 22, insists he did not engage in any sexual activity at all.

The three men, all from Sydney, face trial together for participating in a joint criminal enterprise.

On Friday, some members of the group walked to the nearby Cambridge Hotel, where Miss A and Miss B were on a night out with their own friends.

Miss A and Miss B had interactions with one of the group, ‘Matt’, as well as two men who Crown said were the Hawell brothers.

Miss B said on Friday she had drunk three cans of Smirnoff Double Black before going to the pub and bought another shortly after arriving.

“Matt asked (Miss A) to guess his culture,” said Miss B. “When Matt asked (Miss A) about his culture, he said, “Answer three questions; If you’re wrong, then you have to kiss me.”

The couple kissed and a man the Crown said was Maurice Hawell was introduced to Miss B as Joseph.

Miss B said she was “a little hesitant” when she and Miss A agreed to return to the Airbnb with Matt and “Joseph.” “I didn’t know where we were going,” she told the jury.

Once inside the Parry Street apartment, Miss B said she noticed an open-plan kitchen and lounge, as well as two of the bedrooms. “She looked good,” she told the jury.

Miss A, who like Miss B, gave evidence via audio-visual link, remembered the state of the property differently.

“I remember the kitchen was a disaster,” he said in one of his statements to the police. “There were shot glasses everywhere.”

Judge Gina O’Rourke noted that those opinions were subjective. “What is complicated for one may not be complicated for another,” she told the jury.

Miss B entered one bedroom with Maurice Hawell, whom she only knew as “Joseph”, before Miss A entered another with Matt.

“Joseph grabbed my arm and said, ‘Come on,'” said Miss B. “I said, ‘I have to say goodbye to my friend first.’

Miss B said she finally agreed and Maurice Hawell made a phone call. They were still having sex during that conversation and when a second man entered the room.

“He asked if he could take off his pants,” Miss B said of the newcomer. She replied, “Whatever.”

Miss B performed a sexual act with the second man, who the Crown said was David, and they had sexual relations, all of which were consensual.

When that encounter ended, a third man, according to the Crown, was Marius Hawell, allegedly entered the room and, according to Miss B, asked her how she felt before touching her sexually.

Miss B said she went to the other bedroom and found Miss B with Matt and the two women went to the bathroom together.

They then returned to the bedroom where Miss A had had sex with Matt so they could collect their phones and return to Cambridge.

Miss B said that when they entered the bedroom the light was on but someone turned it off. “They pushed me on the bed,” she told the jury.

Miss B said she was on her back when two men began to sexually assault her.

Miss A has given evidence that she was being sexually assaulted at the same time, but she did not know that Miss A was in the room with her.

“(Miss A) asked where Matt was,” Miss B said. More than one male voice responded: “I’m Matt,” she told the jury.

Matt is not accused of committing any crime at any time and has never been charged with any crime in connection with what happened at the apartment.

Miss A has said that when she and Miss B left Airbnb they returned to Cambridge with Matt, whom she kissed again on the dance floor.

She had told her friends that she had had sex with Matt, but did not mention being assaulted by anyone.

“I kept the whole group thing to myself,” Miss A told the jury. “I felt embarrassed and embarrassed by what had happened.”

Miss A said she exchanged phone numbers and Snapchat details with Matt and days later sent him naked photos of herself.

“I still wanted to meet him,” he said. “It was still cool and fun.”

Maurice Hawell and David are charged with eight counts of aggravated sexual assault in company and one count each of aggravated sexual touching of another person and attempted aggravated sexual assault in company.

Miss B will resume her evidence when the trial continues on Monday.
