Alec Baldwin launches legal battle against armorer on Rust set after cinematographer was shot dead

Alec Baldwin filed a lawsuit Friday against the gunsmith and three other crew members over the fatal shooting on the set of the western film “Rest,” in which a gun Baldwin used during rehearsal killed cameraman Halyna Hutchins.

Hutchins was murdered just over a year ago – on October 21, 2021 – and the set was shut down at the Bonanza Creek Ranch in Sante Fe.

Earlier this month, the producers said shooting would resume in January after reaching a confidential settlement with Hutchins’ widow, Matthew. He will now serve as the film’s executive producer under as part of an agreement under the settlement.

Despite announcing the settlement, the local prosecutor’s office warned that the deal will not affect the criminal investigation into the death, adding: “No one is above the law.”

Baldwin’s lawsuit was filed in Los Angeles County Superior Court as a cross-complaint as a result of an earlier lawsuit in which another member of the crew named Baldwin and the others as defendants.

Baldwin’s complaint lists coats of arms as Hannah Gutierrez-Reed, first assistant director Dave Halls, prop supplier Seth Kenney, and prop master Sarah Zachry.

It is one of several lawsuits arising from the tragedy, which is also under criminal investigation and could lead to charges by the state of New Mexico against the Emmy-winning actor.

The cameraman was shot by a gun Baldwin was holding, but the actor insists he didn’t pull the trigger and blames the prop managers for not checking that the gun was loaded.

Attorneys for Gutierrez-Reed, Halls and Kenney did not immediately respond to requests for statements in defense of their clients.

All four were also named as defendants along with Baldwin in the original lawsuit filed by a script supervisor who claimed the shooting caused her serious emotional problems.

Baldwin’s complaint alleges negligence and demands damages to be determined at trial for the “immense grief” he must endure.

The lawsuit was written by Luke Nikas, a Baldwin attorney who works at the Quinn Emanuel firm.

Hutchins was killed when a revolver Baldwin was rehearsing with while filming in New Mexico fired a live round that hit her and film director Joel Souza, who survived.

In a television interview, the actor said he failed to pull the trigger on the Colt .45 revolver and fired it after cocking it.

An FBI forensic test of the single-action revolver found that it “functioned normally” and would not fire without the trigger being pulled.

Baldwin announced the return of Rust’s production in a post on his Instagram page, noting that the move was part of a “specific desire to do what’s best for Halyna’s son” after she was shot dead.

He wrote on social media: “Throughout this difficult process, everyone has maintained a specific desire to do what is best for Halyna’s son.

Matthew Hutchins has previously said his wife Halyna’s death was a “terrible accident.”

“I’m not interested in blaming or attributing blame (to the producers or Mr. Baldwin),” Matthew said earlier. “We all believe that Halyna’s death was a terrible accident.

“I’m grateful that the producers and the entertainment community have come together to pay tribute to Halyna’s latest work.”

Following the announcement of the civil settlement, the DA’s office said: “The proposed settlement announced today in Matthew Hutchins’ wrongful death trial against Rust film producers, including Alec Baldwin, in the death of Halyna Hutchins will not affect officer of Justice Mary Carmack -Altweis’ ongoing investigation or her final decision to file criminal charges in the case.”
