Former AFL footballer Daniel Menzel has been facing a court charged with unlawfully sexually touching a woman in his Bondi Beach home twice.

The former Sydney Swans player, 29, pleaded not guilty to both charges after leaving the Bondi Hotel with the woman and walking to his house in November 2019.

The woman entered a state of “ somewhat confused ” and found Menzel on top of her, folding her arms above her head and kissing her, prosecutor Nicole McMahon told Downing Center court on Monday.

The former Geelong and Sydney attacker then got off the woman and the couple had a brief discussion, the court heard.

“It is alleged that (Menzel) is again pressing down on the victim’s hands, kissing her in the mouth, and allegedly aggressively placing his hands under her clothing,” Sergeant McMahon said.

The woman reported to the police the next day, saying she may have been drugged, the court heard.

Chief detective Jacob Vassallo agreed that a toxicology report indicated there was no sign of the drug GHB, but there were signs of alcohol and MDMA in her system at the time of the test.

CCTV shows Menzel and the woman speaking at a table and also dancing at the Bondi Hotel, where they had traveled together from the Bedouin nightclub in Double Bay.

Twelve minutes after she was seen walking to his house with Menzel, the court heard that she was sending a message to friends: “Where are you … I feel like I’m about to be raped … help.”

About 76 minutes later, another message from the woman said, “I was drugged … I’m fine xx love you,” police said.

The messages on the woman’s phone also hinted at her giving herself a cap of MDMA on Bedouins.

The lead investigator said he hadn’t noticed the drug use conversation when he first saw her phone, but had discussed it with her the next day.

“Until you discussed that, was she willing with you?” Asked Menzel’s attorney Julia-Ann Hickleton.

“She disclosed it at the time of the formal statement,” the officer replied.

Menzel, who has no criminal record, discussed the matter with the police before being charged.

The Adelaide-born man currently plays for Woodville-West Torrens in the South Australian National Football League, after being dropped by the Swans in late 2019.

He was a first-round draft pick, debuting for Geelong in 2010 and was a rising star before ripping a knee ligament in the 2011 final.

Four knee reconstructions later, he returned for the Cats late in the 2015 season, before moving on to the end of the 2018 season.

After further surgery, this time on his groin, Menzel managed to play seven games for Sydney in his last year in the AFL.

The hearing, before Magistrate Michael Crompton, will resume at a later date.
