He was released on bail pending an ongoing investigation.
The examining magistrate who made the decision, who was sitting in a court in the nearby town of Fira, justified the decision by saying the suspect lived in the local area and was not a flight risk.
The name of the dead Briton was not released and it was not clear last night if he lived in the area or was on holiday.
It is believed he was cycling alone when he was run over.
The road in which he was hit is an A-6111R.

Civil Guard sources confirmed that they concluded that the driver involved in the hit-and-run accident did not stop at the scene of the accident in a report sent to the Investigation Court.
Torre is home to about 3,500 people and is known for its views of the Sierra Cabrera mountain range, whose peaks rise to about 3,000 feet above sea level.
It is a popular area for cycling as well as it attracts hikers.
Mojacar, which is very popular with the Brits, is only 15 minutes away by car.
