31-year-old woman who became pregnant with 13-year-old’s baby won’t go to jail

A 31-year-old Colorado woman is banned from seeing the inside of a prison cell despite having sex with a 13-year-old boy in June 2022.

It later emerged that Andrea Serrano had become pregnant as a result of the minor’s sexual assault. She was released on $70,000 bail shortly after her original arrest last July.

Fountain police had charged Serrano with assault of a child by someone in a position of trust, as well as assault of a child. Investigators said Serrano admitted to the relationship.

It was widely reported Friday that Serrano’s lawyers had reached a plea deal with prosecutors that will force her to register as a sex offender but means she will avoid jail.

Since her arrest, Serrano has given birth to the teen’s baby. The child is under her care. His family plans to petition the court for custody. The victim is now 14 years old.

Serrano was first questioned by police after a therapist found out and came forward with the allegations. After being interviewed by Fountain police, Serrano confessed to her crimes.

He looked at her as a maternal figure and even referred to her as ‘mom’ before, according to the criminal statement in the case, quoted by the Colorado Springs Gazette.

“I feel like my son has been robbed of his childhood. Now he has to become a father. He is a victim and he will have to live with that for the rest of his life,” said the victim’s mother. KKTV after the plea deal was made public.

“I feel like if she was a man and he was a little girl, it would definitely be different. They would look for more. I feel like because he’s not a woman, they aren’t. They feel sorry for her,” she added.

At her arrest KOAA reported that Serrano and her victim lived together for a while.

The victim’s real mother told the Gazette that she spoke to the judge in the case before accepting the plea deal to express her displeasure.

KKTV’s report says Serrano’s plea deal covers lower charges and the judge could still sentence her to 10 years to life of “sex offender intensive supervised probation.”

Serrano faces a hearing in May that will determine the length of her probation.

The Gazette reports that the “minor charge” is one of incest, a class four felony in Colorado.

Ahead of her probation hearing, Serrano is also due in court in March and faces two additional charges for violating the terms of a restraining order.

The town of Fountain is located just south of Colorado Springs.
